The applicable laws are listed in the link.

I'm not being difficult but I can not find which Act this relates to. I can see it on the Highway Code but what Act and what section?

hintza means (i think) that that is only the highway code, and not actually a statutory road traffic act.
    however: http://www.bbc.co.uk/dna/h2g2/A685235

    Indeed,

It quotes " The Highway Code is not law, but it does include many points of law (denoted by the word must in bold type). "

It will be one of these:

    [Laws CUR reg 98, 105 & 107, RVLR reg 27 & RTA 1988 sect 42]

" you MUST apply the handbrake before leaving the vehicle "

Is that not when you are parking the vehicle at the roadside? I use my drive and leave the handbrake off.

I have looked at all of those and can't find anything.

Use off-street parking areas, or bays marked out with white lines on the road as parking places, wherever possible. If you have to stop on the roadside

So no legal requirement to use a handbrake in your drive, if using off street parking or marked bays.

When parked on the public highway it is mandatory for any vehicle exceeding 750Kg to be secured by a parking brake. Vehicles below this weight should be chocked unless they are secured by a mechanical device such as a handbrake or gearbox.

However, I don't see how this law can be enforced efficiently.

  • im going to throw a spanner in the works here, my parking brake uses brake shoes rather than discs and pads. will mine still freeze?
when i replaced the springs on them there was no temperature related warnings like, "caution this spring will not seperate frozen brake shoes from drums under -6 degrees"
    ...work permit granted!
  • Are all parking brakes not shoes?
