PPI claiming - Freemans catalogue

HIya
I recently put in a claim to Freemans catalogue for PPI. This always appeared on my account. I automnatically assumed it was essential to have as it was a catalogue. I've been with this company for over ten years. I got a reply from my first template letter to them the other day stating they are unable to refund as requested.
They say they confirm all their policies have always been optional and always sold as such. Every monthly statement I have received has always made reference to this policy and it was always possible for customers to cancel at any time. They say their sales processes have always had regard to the legal requirements in force at the time and they would like to point out the detailed rules currently enforced by the FSA were not applicable at the time this policy was taken out.
Firstly does this mean I haven't any chance of reclaiming because I was a dumb !!! in the first place and didn'y know I could cancel it. Or is it pointless anyway because the rules by the FSA weren'y applicable then?
Sorry if this seems straight forward I think I just need someone to confirm as my heads now buzzing and I'm confusing myself more...

What a fob off this is.
The usual - when they are older cases, thinking that you cannot do anything about it anyway, but do not give up quite yet, they must have an "insurer", find out who these are by contacting the catalogue company or write to the catalogue for the policy details of the insurance, they must send you these on request, where the insurers details will and should be shown, you then pursue with these as you have done the catalogue.
Then if they say no........where to what I know of many do not accept liability, the FOS are trying to make these responsible too, and they would and should have been governed, no matter what year you first taken this out.
Its another direction to go for, but if they do say no, move on to the FOS.

Thank you Dix Needed a bit of reassurance there as I'm new to all this as you know. I will write them a letter tomorrow asking these details as they added at the end of the letter if they didn't hear from me in 8 weeks they would close the case. Thanks again its appreciated :T

Its well worth keeping on at them first until you receive a final decision, but also worth requesting for the policy details too just in case as another direction to take.

Just realised when I went to write them a letter that they have given me the address for the company (Assurant Solutions) the insurance is with that I can write to. Quick question..do I send the same letter to them as I sent to freemans originally? I sent them the first template letter. Will I just add an additional part to the letter explaining I got in touch with freemans and they gave me their address? Or do I send them a copy of the letter sent to freemans and an additional letter to themselves explaining I was advised to contact them?

Also, once I have written to the Insurance company, should I also write to freemans letting them know I have done so? So that they know I'm not happy for the case to be closed and I am pursuing the matter?

Hi Twinkle.
I would write that you have already wrote to Freemans (enclose a copy of the letter if you still have this) and tell them you are aware that they also have a responsibility in regards of the insurance, and are requesting they look into this matter for you by 8 weeks.
Then if they write back with a "NO", go to the FOS who will consider taking this on for you.

excellent! Thanks again Di. I still have copies of all my letters I keep them on my computer and a flash drive
I think I will write to freemans also to make them aware I am not happy and I am pusueing the matter
