Lloyds tsb c/c

Hi
My wife has a c/c with LIES tsb she has recently cancelled her payment protection cover after finding out that the policy did not cover her for unemployment. Having spoke to some one from lies tsb via phone she was told it would be cancelled and that they would investigate claim of misselling, she has since received confirmation of investigation by letter. Two weeks later she paid monthly payment excluding premiem for ppi, she has now received a letter demanding ppi for that month and also been charged £12 default sum. What i dont get is why should she pay for a policy that is no use and never has been ie only works 5 hours a week.
Can anyone explain any implications if she refuses to pay this, help very much appreciated. Thanks

    Hi there

I was previously successful for reclaiming on a credit card ppi (lloyds) but through the Financial ombudsman service (FOS) because I was sold the PPI with just receiving benefits for the children, and not working.

Your wife is not fully protected, although they may try it on by stating she would be protected for life cover/hospitalisation and job solutions, but I do not think its fair to pay out for something that does not fully protect.

Have you actually tried to reclaim as well?
    If not then I would.
    More info here:
    http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance
I would also let them know the same time that the ppi was cancelled and not to demand for the payments on the letter, the same time as reclaiming.
However, personally I would have wrote to them to cancel to make sure they do this, so on the reclaim letter do mention you want this cancelled if they did not do this when requested earlier.
The above link is the guidelines to reclaiming, check this out, they have 8 weeks in full to respond, keep a them, and again if you can try to post by recorded delivery for proof of posting.

In regards of the charges of this, and advice on default, it may be a good idea to post about this part on the reclaim card charges etc, to keep it separate from the reclaiming side of it.

Good luck, please keep us posted and post up for help when required.

    Fingers crossed.:)

  • Hi,
Thanks for promt responce, during phone conversation to cancell ppi they told her that they will investigate a claim for misselling. She received a letter saying they would look into this matter and will do thier best to complete their enquiries about 4 weeks ago.. We are also going to complain the fact that having started off with with c/c limit of £2500 in 2002 they have upped this several times to £8500, £13000, £15000 without giving them permission at any time to do this. Her current c/c statement also states that as a RESPONSIBLE LENDER they have reviewed her credit limit and decreased this to £9500 not bad for some one that only earns £130 per month, is there any coarse of action she could take regarding this matter ? Having cut her card up 3 months ago we are now going to close our account with lies tsb as soon as we can pay off our overdraft as they have stated that under their terms they can transfer any available funds from our account to offset any arrears. It seems to me that having cancelled her ppi they are now intent on making life very awkward.

Well it seems like a good case here, if they don't uphold in her favour then I'm sure the FOS will with no problems, where in this case if it went this far, then request for distress compensation on top as well.

    Good luck.;)

  • Hi,
Just an update, wife phoned lloyds today to complain about thier demand for cancelled ppi premiem they say that because that months statement includes ppi she still has to pay them otherwise she will get another £12 default fee +interest charges ? Cant understand why she should have to pay for something that has been cancelled and was never any use to her although lloyds are trying to say that she would of been elegible for other elements of policy. Just wrote letter of complaint ready to forward in morning also put in letter questioning thier RESPONSIBLE LENDER stating that because she only earns £132 per month and that giving her such an high credit limit makes a mockery of thier claim. Is there any thing she can do legally about them giving her such an high amount of credit several times without her permission or signature Any help on these matters much appreciated. Thanks

    Hi there

you have done the right thing by writing to them to complain about this matter.
The normal fob off is "you would still be covered for life cover/hospitalisation/job solutions etc, but still why should your wife pay full cover for something she if not going to "fully" benefit for anyway.

I would try to find the terms and conds of this policy, this £12 issue I do not understand that, but if they do not resolve this in her favour then move it on to the FOS.;)

    So sorry to hear this.

Is your wife actually in the overdraft?

Hope they resolve this for you soon, I'm sure someone will have some advice for you on this and post up soon of the best action to take here in regards of the overdraft.

    Hi There

They usually need 30 days to cancel. Had you given them the 30 days.

  • Hi,
Thanks for reply, yes she is in overdraft up to limit. seems to me that they are punishing her for having the cheek to ask for ppi refund, they know at this moment in time we are struggling financially unlike lies tsb we havent got any one to bail us out. Cant wait to get shot of all our accounts with this greedy bunch !
  • HI max,
Thanks for reply, they did not mention 30 days but at the end of the day this is a premiem for a policy that is of no use anyway and as a clear cut case of misselling will have to refund all premiems+interest.
