    If it had happened to me i would have just put the two items to one side and then walked out. Its only classified as shoplifting if you leave the actual building with the items on you.

    i can see it was a !!!! up with tesco. Which happened to me once when i was buying mascara for my other half. I scanned it i heard it beep. But it did not come up on the receipt.

    if they try to detain you then you should try to leave. Never ever let them escort you out of the sight of the public area "ie in front of the shoppers"

    there are more witnesses there where they could be called if you decided to sue.

    but really you should just leave. They have no right to hold or detain anyone. They are just ordinary people like you or i only the police can detain.

    sorry to hear that she was treated that way. When they try to get you to sign documents its usually so they can recover money from you.

    I would go to citizens advice they can help with this kind of case

    ooh you're a harsh bunch - don't forget your writing about this man's wife. It does sound slightly dubious to me, as a case, but presumably some information has been left out of the email. In any case I am no expert.
    The reason I'm writing is that I read somewhere a long time ago that it is illegal to be searched without a police officer present, if you have requested one. It's perhaps not applicable in this case - but like I say, there seems to be some information missing so maybe it is applicable.
    Good luck and thanks for the email address for Mr Leahy - I have my own battle currently with Tesco Diets. Seems to be that Tesco get confused between themselves and God sometimes, but that's just how it seems to me.

    I think its more along the lines of shoplifting technically hasnt occured if a offer of payment has been made.

    Of course when this offer is made would be taken into consideration in a court case. Mistakes do happen but as previous posters have said, how could the lipsticks get from basket to bag? While she may have done it absentmindedl when looking for something else, its extremely unlikely.

    Is the OP sure his wife hasnt maybe done this? Often shoplifters who have no need to shoplift (ie to feed a drug habit or because they're poor) do so because they crave attention and feel that being caught shoplifting would give them this attention from the person they want it from (ie other half, parents, kids).

    Of course if they took you to small claims, it is likely they would disclose cctv footage (although if she has signed a form saying she did it - this may not be needed). In which - if your wife has made an offer of payment etc - should be at least semi apparent. Of course if your wife did steal them and the cctv would show her putting the items into her bag while checking no one was looking, she'd be pretty much stuffed.

    I believe the act of shoplifting occurs when someone tries to permanently deprive the owner of their goods with no offer of payment being attempted.

    But in small claims, i blieve you only have to prove that what is likely, not beyond a reasonable doubt like you do in criminal court.

    Probably why Tesco are going through civil proceedings rather than criminal.
