  • No response from the Argus... Mr EL will be there with me on the 13th - all I will be thinking about is the fact that on 16th Dec we leave to Thailand!

    Will def keep things simple and use highlighter pen.

    We have decided to change the landladys address with the court and then follow this up with the £55 Bailiff option (Warrant Of Execution) but I don't know when. Mind you, could be good to to before Christmas, if nothing else would love to see her face... might even do it this week (presume I need to fill in yet another form from the court?) - what does everyone think?

    Well my tuppence worth:

    As far as the court appearance of the agent I doubt you will get your money back, this argument is with the landlady. But I think you should be able to get confirmation of the landladies new address. I would ask the agent in court to confirm the new address and what proof of address they asked the landlady for.

    Meanwhile if you register this new address with the court, provided you have been able to confirm the address actually exists and is not a a hybrid of 2 roads close by as you were concerned about before. Then either it's the right address and you can carry on or it's not the right address in which case the bailiff will be turned away but then you've got evidence of providing fraudulent proof of address to the agent stated in court. This is going to look bad for both the agent and landlady.

    I will leaving my privately rented flat, hopefully in the very near future, and am overwhelmed at all the info available here plus all the support you have had. My landlord better not mess me around or else!!! I am moving back to Brighton so will avoid Parks at all costs!!

    I too had to take someone to CC (my ex!!) and it was held in Brighton. EL, have no worries about the court. The is just a little waiting area and then you go through to an office where the judge is. I had a very nice lady judge and she put me at ease straight away. I thought it would be nerve racking but not at all.

    Chin up and positive thoughts from this Brightonian in far away South Wales!!

  • I can't believe it still hasn't been resolved. Kepp on at it. You'll get there in the end, the landlady sounds very dodgy as do the letting agents. Hmmmm.

  • Thanks so much guys - the thought of having to sift through the pile of paperwork is enough to make anyone lose the will to live but I know it has to be done, this week too, so that it arrives at the court in time (I will hand deliver of course). It's nice to know you're all still here!

    Still no letter saying the notification was returned unopened to them - we just have to rely on what the agent has told us I guess.

  • Been waking up the last 2 nights at 5am with horrible migraines - don't know what's going on. I think it's because I am worrying about things but why does it happen at that time in the morning when I need to sleep? Of course then I find it hard to get back to sleep and end up sleepy through most of the morning.

    For the court appearance with letting agent, I am thinking of:

    - Photocopying each letter/document that is relevant
    - Numbering each photocopied document
    - Writing a summary letter with a description of each numbered item and why we feel it is relevant
    - Posting all to court or hand delivering if I have time

    Is this the right way to do it?
