    Faxing the LA tomorrow will cost me nothing and we can state that if the cheque is received within the next 7 days we will take no further legal action against them?

    That sounds reasonable. I wouldn't mention what action you will take against them.

    Wasn't it said much earlier in the thread that you should get the Court to set a charge against the property (i.e. the sum you're now owed) through the Land Registry (or something like that)?

    I think the OP would prefer a more expedient return of their money.

    Getting it from the LA would leave only a small balance outstanding.

  • Thanks everyone - forgot to bring the darned paperwork in to fax the LA - still, will create the fax today so it is ready.

    Should I mention ARLA and local media, but not mention charge against property then?

    For example:

    "You will note the enclosed court decision in our favour. The sum of £718 is due to us with immediate effect, £625 of which is held by yourselves.

    You still deal with the landlord therefore payment is expected from yourselves or the landlord within 7 days from today's date.

    Should we not receive payment by the xxxxxxx November, we will be taking further action involving local media, ARLA and further court procedures.

    We therefore trust you will assist in resolving this matter expediently within 7 days"

  • I think it is OK apart from the bit about the local media and ARLA. I would not put that but others might disagree with me. I would just stick to the legal/court bits.

    Am taking back the keys to LA this evening for my rental so my fingers are crossed for a smooth return of my deposit (the flat glowed with cleanliness when we left!)

    Wow, what a great thread. Its taken me 2 hours to read, but I'm at work so I'm being paid to read it (provided I don't get noticed).

    Just wanted to share my thoughts with you:-

    You've got judgement but getting the cash could prove more difficult. Do any of her other tenants pay rent still to the letting Agent? If so can you get the court to order that they pay you out of the rent that they receive?


    I rented 6 times (at Uni and just after I left) and ended up suing 2 landlords in total (well actually I sued the agent the second time and the judge told me I'd sued the wrong person, but I could substitue the landlord on the court docs instead). I won both.
