    having said all that, i am embarking on my first eviction in 6 years, and it is breaking my heart to be honest - a young single parent mum, whose behaviour and that of her mates is terrorising the older neighbours and grannies in the street, and damage has been done to neighbours cars, and properties. i have no choice, but, it is still hard. i cannot get her out without a court order (the local council will not rehouse her as an emergency without one) and yet having a CCJ against her will make her future life SO much more difficult. Both she and I are trapped betwixt a rock and a hard place with this dotty legislation. i have given her so many chances, and had so many chats to her. sadly, it has to be done. In law i am responsible for my tenants behavioiur, and i could be taken to court.

    Clutton I feel so bad for you. We have had some awful tenants but never so bad that we have had to evict them. About the worst were some nurses - we thought there were two of them who had friends over occasionally but it turns out (some neighbours kept a diary because of the nuisance) that there were at least a dozen and they rotated the beds when they were on night duty. It was a two bedroom flat and the comings and goings annoyed the neighbours to the extent that they complained to the Council who asked the neighbours to keep a diary. Some of them were very zealous and videoed who went in and what time they came out, it was like a documentary. Anyway it impressed the Council who sent letters about overcrowding, fire hazards and all the rest. To cut a long story short we gave them Notice via the agent and they left at the end of the two months.
    The best tenants in the world are young professionals who do a 12 hour day and eat out or buy a take away.

    Congrats EagerLearner - it must feel good to know things are moving! I'm in the same boat myself (just posted our allocation questionnaire today); and it's so frustrating. The landlord has posted a counterclaim, he has our £1350 deposit and my finances are pretty tight at the best of times! Reading this thread has reassured me that we're not the only ones going through this, but it feels so frustrating that 7 months down the line, we still don't have our money back, and so far we've incurred £220 of court fees trying to get back what's rightfully ours. People like this give good landlords a bad name!

    Thanks so much everyone - I can't tell you how much it has meant to me/us having this kind of support, being 'virgins' in this territory!

    I do still worry that this filing in court has thrown good money after bad, but I have to pray that when that paperwork from the courts lands with her, she will be shocked enough to pay up. I mean, she will be REALLY freaked out that we found out where she lives as she was so specific that we didn't even give the c/o address or her mobile to anyone else, as we were 'model tenants but the others weren't'! So now we have traced her back to home sweet home, I'd love to be a fly on the wall.

    Re: journalists, I wonder whether they would touch it you know - I mean everyone knows generally landlords are seen in a bad light (present company ex-clu-ded of course...) so would it be newsworthy? The only evidence we have is our original inventory plus the fact that her charges relate to property maintenance rather than actual damage...

    Liz545 - eeek - you have been waiting how long, and spent how much??? Oh, I'm scared now... so much for our £625 - you are waiting for far more! What is your ex-landlord trying to claim for? Is it similar items to us?

    I've just read this thread from start to finish. Whatever happens, this woman has to be brought to justice. The cheak of it outrages me.
