  • Sorry I though I hadnt posted it first time. Anyway im not sure about the 6 year thing. But you cant sell something as leather and deliver somthing different. Its a breach of contract.

    You may not be sure 'about the 6 year thing' but I am reasonably sure. ;)

    The Limitations Act 1980 allows you up to six years to seek a remedy from the seller.

    Yes, it probably is a breach of contract, and you have failed to point that out to the seller within the time limit.

    Can I assume you are not in Scotland?
  • Well if you read the posts on this site. there seens to be a fair few non scots who have been refunded after six years.
  • Hi all. I was wondering if you had resolved this with Furniture Village?

    I am dealing with a similar problem for my mother who purchased a Maxine suite in September 2007. In the past 6 months since the warranty has expired the surface has deteriorated with the top coating peeling and flaking away. The leathercare pack was used in accordance with the instructions since purchase, so that isn't the cause.

    We visited the Furniture Village shop with photographs, and spoke to a salesman, who said that there was nothing the shop could do, but gave us a number for Customer Services. I contacted them via email, and received a response immediately saying that my mail had been passed to the Aftercare Team and I would hear shortly.

    It has been 2 weeks, and had no emails from them. So this morning I called the number I had been given in the email and spoke to a most unhelpful and bored representative who said basically that it was tough luck, as the warranty had run out.

    After spending a good chunk of her pension (£1676), my mother had thought that she would get a good few years of use out of the sofa. 6 years is a joke.

    Anyone else had a successful complaint made for the Maxine range? Thanks....

  • Have been busy with 11 plus revision but it seems that I'm going to have to file a small claim, I don't believe the six year rule applies when there has been blatant misdescription and fraud I believe it goes from when it was discovered ie when it started falling apart .FV position seems to be deny deny and offer a discount on yet more crap from their shop unfortunately I've now got a sofa that's fit for the bin and will prob have to go on free cycle as can't sell it . Will file and see what happens ....
  • Like a lot of others on here, I only found about this recently. I sent my first complaint to FV in mid December, having owned our Scala sofa & sofa bed for nearly 5 years.

    They initially tried to fob me off with an offer of £250 (which they described as "full & final") and then went on to seemingly downgrade this offer to a "discount allowance" of £250 (which was also "full & final"), having claimed I owned the sofas for 6 years! (wrong!)

    I sent a further email pointing out the inaccuracies of their most recent letter and received a phone call the following day, apologising profoundly for a "wholly inaccurate and inappropriate" letter, which they asked me to disregard. The lady on the phone finally admitted to the mis-selling of these sofas by the sales staff, which had been my main point all along! Why would I have paid £1,400 for imitation leather?! These had been sold to us as genuine 100% real leather.

    At present, they are adamant they can not repair or replace, which is what I have requested, but will be sending me a new refund offer shortly.

    I will await the latest "offer", which I'm sure will yet again be "full & final". ;)

    I will post again when I have some more news...

  • hi I am another one scammed into buying the scala range as full genuine leather, I have the original advertisement card with leather kitemark on it, and sales receipt saying leather scala suite
    purchased april 2007, started peeling about 8 months ago, contacted store who said it was one of those things
    well my 2 seater is nearly bald, 3 seater is bald even though no one sits in those places, footstall where no contact made peeling and chair just starting to peel
    found this site few weeks ago but didn't join.
    went into FV (Romford) 2 weeks ago and sales person said straight away ring customer services. spoke to young lady who said out of warranty etc, then explained problem and said fv are aware, she spoke to supervisor, gave me email addresss and said sent pics, 15 in total, I paid £1400 and expected it to last 15 years at least (as previous leather suite did and still have 2 chairs upstairs still going 20 years on). she phoned and said they would offer me £233 as was out of 5 yr warranty, but out of goodwill would extend to 8 years !
    got a letter to confirm and they said if do not reply 21 days then they will close file.
    what a joke offer !!! at the end of the day they sold me a leather suite not a plastic one. so I will battle on until happy - I tried out the dante in store and do not like it at all so not getting one of those.
    did anyone actually get full refund? did anyone issue court claim against them? any advice much appreciated and will not accept this offer

    I didn't get a full refund, and didn't expect one.

    I got 50% and kept the sofa (still sat on it now) - yes its got a bald arm and a few of the seats are 'crispy' where its pealed, but it has a throw over it (Teddy throw from dunelm mill - its perfect for covering and the dogs lie on that sofa anyway) as we're moving house soon and will need a different sofa shape anyway...
