Have had confirmation letter from SRA Complaints Procedure confirming telephone call the other day and the information that was given. They have written to Solicitor and we await his response.

I have to say they are very easy to deal with very much like the FOS. Very friendly and helpful so anybody concerned about complaining about their solicitor please don't be.

That is positive then maxdp. This is with Watsons isn't it? I would think from what others have posted that they will release you without charge so to speak. Maybe though, some solicitors will not be!! (so to speak!!).

Yes that is correct. The Complaints service gentleman said that he could not see them charging and if they did it would be "inadviseable". I think if people complain about their Solicitors then this should not be an issue. Mind you it all depends how they were serviced by the Solicitor some have been better than others.

  • I received a letter from Lloyds today asking me to fill in a questionairre and send any paperwork I have to them. Should I send copies of the breakdown letter of how my rebate etc was calculated and copy of my Credit Agreement or hold tight with them for a bit to see what they come up with?

Hi Millwallpaul, Is this to do with a loan with LLoyds that went to Loancheck? Also is it a PPI misselling complaint? If it is then do you have all your details for it? The list of questions are normal but only answer these correct to your knowledge as you could be dropping yourself in it. Really and truely they should hold your agreement and breakdown of settlement themselves.

    Hi Marshallka

Yes this is the one you recommended I used the FOS to claim against Lloyds insurers.

I have filled it out OK, not giving too much explination and used Matin's guide to help. All I stated is that I paid a single premium for my policy but did not see it through to the end and that I feel I was mis sold the policy & didn't receive a fair rebate when I settled it.

Do think I shouldn't send the documents then? I was just worried that as they were only the insurers, it may take a bit more time for them to get them and hold things up.

Oh OK, I thought you meant Lloyds Bank. Are you going for the misselling with them and who wrote to them, you or FOS. FOS wrote for me and it was only for the unfair rebate but I know they are taking complaints against them for misselling. After FOS wrote for me it was passed to Jubilee (Cassidy Davis) who called me (I think) to ask if I could write a letter to Firstplus to agree to them passing over the file. I did that and then I remained in contact with lloyds who asked for more time to deal with this but I passed it to FOS. It was then another 13/14 months until I received an offer from LLoyds (of just a fair rebate) and this was not adjudicated on. FOS did allow me to keep in touch though all the time. At that time FOS did not have actual jurisdcition over complaints for misselling BUT they told me that their solicitors and Lloyds solicitors were having meetings all the time. Have you spoken to FOS?
  • Yes it was the FOS who wrote to Lloyds on my behalf after I contacted them. Lloyds have sent me a complaints questionairre to fill in which will give them the relevant details to look into my claim. They have asked for the syndicate numbers which may lead them to write back to me saying it will now be against Cassidy and others, we will see.

The FOS said if it isn't settled in 8 weeks, to get back in touch with them, so they can make a ruling, which looks like it is in their juristiction now, which hopefully can only be a good thing. Fingers crossed.

Hi, yes, you would need a copy of the terms and conditions and policy from Lloyds as that would have the Lloyds sydicate on it. I would be 90% sure this would be Cassidy Davis they would pass the complaint onto. Do you have the syndicate numbers?

Paul, FOS are definately accepting these complaints so that is a good sign. They may even have jurisdiction over them now. It is certainly better than nothing in that you may win misselling and they were not difficult to get the money out of and paid almost immediate that they had my acceptance. I bet that was cause they knew that FOS would not be too long in making them responsible for missales and wanted me off their backs lol. I even asked for a nicer hamper and champers from them but they did not oblige. They told me to ask the man in the big red suit for that one but at least they could have a joke after me taking money back from them.
  • I haven't got any paperwork from Lloyds insurers. The only paperwork I have is First Plus credit agreement and PPI booklet which lists the two syndicate numbers that I have put on the questionaire.
