    You've way jumped the gun and sent a prove it letter mate! You should have read it and went with the procedure, i.e. letter 1 through 4. ;)

    As you sent the wrong letter, they have longer to respond meaning you have to leave them until 14 days (+2) but to you it means 3 weeks.

    If they do not respond then wait - don't send a reminder, no need. Give them a month or so to get back to you - obviously you're not paying are you?

    ahhhhh so many letters lol

    nope have not paid anything to phoenix ever mate not a penny so its nearly 3 years with no contact or payment, ok I will wait as long as you tell me buddy i know fook all about how to do all this lol (hence wrong letter =P)

    an update for you mate,

    in total phoenix placed 3 defaults for 3 accounts on my credit file, they have now agreed to remove two of the entries completely including the defaults on there next update so a bloody good result

    this was there response to equifax:

    Response (Administrator) 19/02/2010 01.47 PM Good Afternoon,

    We have been advised that there is no CCA available for this account, and as a result, this account will be withdrawn from us. Our entry will be removed in our next update.

    so that is two out of the 3, the last one they are claiming they have a CCA and it will be sent so they are refusing so far to remove the default, but two out of 3 is bloody fantastic..

    will just battle the last entry and see how that goes

    hi mate,

    right had a letter through this morning with a signed cca which is attached.

    I do have a query, the name on the cca is different to the name they have been writing to and the name on the CRA reports,

    my name on the cca for example is wayne bloggs

    and they have registered with the CRA's for example is Wayne Peter (example)

    there letters have also Wayne Peter

    but the cca clearly states at the top in there print Mr Wayne bloggs

    i don't know if the cca is any good have a look at it and let me know, also attached is the letter they posted to me addressed Mr Wayne Peter not the name on the cca lol

    Mate before I spend time on this, tell me one this - was this a flexible account, i.e. the one with the card that you could use in Littlewoods (Extra) stores? If so, then great - these accounts never had provision to allow for CRA sharing so it is quite illegal for them to share data....

    Also, on the agreement they sent is it your signature and was the extra info filled in at the bottom with dob/phone etc?

    Please confirm before I proceed with advice.

    and no it was just for the catalogue on-line (littlewoods extra), at the top of the cca it does say "Flexible account credit agreement" don't know if that helps...

    i don't know if i have missed it but there is nothing on the CCA that states they will share information with CRA's, do they have to state that on the agreement ?

    Yes mate they do have to state it lol - its a well known flaw with littlewoods flexible accounts, they omit the fact they can share data with CRA's lol.

    I had one removed myself as a result of this fault (not my debt either), i'm looking for the letter I sent - i'll post it here soon enough for you. Bear with me :D
