Disabled travel pass refused, can i sue?

    I feel that the OP's attitude is typical of whats wrong with this country. You want a free buspass paid for by the state (which given your condition I don't disagree with by the way), they have told you how to apply for it but you don't want to go through all that hassle so want to sue them because for some reason you feel that you should be exempt for the rules that apply to everyone else.

    Exactly. I was under the impression that with an illness like epilepsy, you had to apply for the licence first, unless you have a letter that informs you that the DVLA believe you are unfit to drive.

    As you can see from what Tally Ho posted, The rules do not require that i apply for a licence. GMPTE are deliberately trying to make this as difficult as possible. Newcastle only wanted a letter from my doctor.

    Reread the guidance notes. The exemption is not automatic for those with epilepsy, and the LA need to be confident that you do not qualify for a licence. It is not nearly as simple as you believe it to be.

  • I have never been asked to apply for licence in Merseyside. The Guidance says 'would if they applied'. Thats where the medical/interview for the bus pass comes in. The doctor should be well aware of what would bar someone with epilepsy from driving. My answers about my seizure patterns has always been enough to satisfy Merseytravel that I would if I applied be refused and issued me with my bus pass.

    Surely if someone applies for a licence and the DVLA refuses to issue one because the applicant has epilepsy the £50 fee won't be charged ?

    The £50 is an administration fee. It is up to the DVLA if they choose to refund it. My guess is they would keep it on the grounds that anybody who has occasional fits should not be stupid enough to drive.

    Don't worry about it you know your rights now and anybody with any common sense knows they're in the wrong for being difficult just for the sake of it and it clearly sounds like they have a reputation for it too so take the info and go get your pass.

    Any further moaning at you for having a problem with them is just pointless and a tad petty so I've no idea what it's done to achieve. Some people are actualy starting to sound like they want you to have to pay the money and it'll be unjust if you don't.

    Ignore it and I hope you get your bus pass sorted out soon.

  • My brother is having the same problem with GMPTE. He moved to Manchester from London last year. Nobody really knows what is wrong with him but the latest theory is he was born with a brain problem similar to autism. In London he had no problem getting a freedom pass, they just asked for a letter from his doctor or Psychologist. But Manchester have refused him twice and given him this driving licence story.

    Having autism or similar problems doesn't always prevent someone from driving. It's the effects of doing so that generally stop from driving.

  • My brother has got a driving licence. Sometimes he is ok but the slightest little problem freaks him out. He can't deal with anything that disrupts his routine.
