Hi
I posted a thread a few weeks ago about a letter which DH received from Roxburghe about HFO Limited

We sent the prove it letter by recorded delivery the following day, we have now received another letter saying that due to receiving no response from him they are giving us 72 hours to get in touch otherwise there may be legal action involved, what can I do? I don't want to ring them for the reason HellsGranny gave in the other thread

DH is currently in Austria so it's a bit difficult to get a signature on a letter. Should I be worried?:idea: Jan 09. Do Not worry!
Key word is "may", it is a scare tactic to mention court action.
If you sent the previous letter via recorded delivery, simply state in another letter that you did reply (see tracking number) and that you are awaiting there response to that letter.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

Will they wait though? DH has only just left today and won't be home till next weekend.
Quoted from the letter:
Failure to deal with this matter within the time given will result in action being taken without further reference to you. This 'may' involve the commencement of legal proceedings where court fees, solicitors costs and statutory interest can be added thus substantially increasing the amount owed.
This isn't even DH's debt, it's neither of ours, could HG be right in saying that people do this just to get money???:idea: Jan 09. once again the info is in the wording, 'may' , double check on your tracking for your recorded delivery letter, find out if they have received it and sometimes it is possible to get a copy of the signature.
since you have sent the prove it letter and have got proof they have received it (ie recorded delivery) then you do not have to worry, you can do as Darkconvict has said and send another letter stating you have responded quoting tracing number and you will not be doing anything further until they respond to that letter (you can also attach a copy of the prove it letter you sent as well)Drop a brand challenge
on a £100 shop you might on average get 70 items save

Do I need DH to sign it? thats my major problem at the moment as he is away until next weekend, have kept the receipt with the tracking number, tried it on the website and it wouldn't work so will ask in the post office tomorrow:idea: Jan 09. well you should not actually sign anything with your proper signature anyway, it should only ever be signed electronically in block capitals, this is because it has been reported occasionally that some debt collection companies will actually scan and print your signature on the 'proof' documents they send back - basically they have been known to 'forge' an agreement to get you to give them moneyDrop a brand challenge

Oh dear, DH signed the first letter

Can you still fight if that happens? Or is there nothing you can do? I'll definitely remember that in the future if any more of these things turn up!!
I'll get a letter typed up tonight and post it recorded again tomorrow, will also check at the post office the status of the last one.:idea: Jan 09. well yes of course you can as if it is a forgery it is not legal,
however i do not want to worry you as i believe this is not a common practice that i know of more a case of it is not unheard ofDrop a brand challenge

Still haven't heard anything from Roxburghe, BUT we have had a letter from Graham White, Solicitors, who's client is Roxburghe, working on behalf of HFO Capital. It is a letter before action.
Now what do I do? Send a letter to these guys, stating what we have already done and enclose the letters we have sent?:idea: Jan 09.
