All you cna do is send the prove it letter, make sure it is sent recorded so you have proof the letters were delivered.
If they do take you to court you can submit as your defence, you have sent x number of prove it letter asking for proof of your liability to the debt, but they have consistently ignored all your request and you are not willing to make any payment to a debt which may not be yours or enforceable in court. If they do go for court action (CCJ) 10past6 should be able to provide some hints to how to fill in the form.
If they bring proof of the debt to the courts, then you can take it away to discuss it, them failing to provide evidence is your defence.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

You will probably do better to send the template letter on this thread if it is not your debt - particularly as they are claiming to have not received the prove it letter.
Get proof of posting (free from the post office) but don't bother with recorded delivery.0 -
Ok, will do, hope it doesn't get to court though:idea: Jan 09. Debt @ LBM - £11936.55 Debt at worst - £12600.55 Current Debt (01/03/2012) £8,859.51 29.7% Paid offHoneymoon Fund £410.40/£6000 House Deposit £1.50:A Proud to be dealing with my debts. DFW Nerd 1177 :A0

Roxburghe.
If you get another threatening letter from the Solicitors after more than, say, a week after you have sent the letter, go straight to the Financial Ombudsman Service, including a copy of the letter and saying this seems to be how Roxburghe have responded.0 -
Thought I'd bump this one up a bit as received another letter today about this.
On 11th May, I spoke to OTELO who informed me to write and send a letter to their contact name and address at 3, I was told to wait 8 weeks for a reply, if nothing came to then ring them again.
We haven't heard anything from 3, but we have received a letter from Roxburghe this morning. It mentions how we apparantly agreed to make a payment which we have apparantly missed?? The last letter we received was on 16th March which was stating they would be requesting statements from 3.

Does the above class as a response to a prove it letter?
If DH had this debt, surely it would show on his credit report wouldn't it?
Letter dated 07/06/10
You agreed to make a payment to Roxburghe (UK) Ltd. as part of a plan to settle your outstanding debt. (We didn't respond to the above letter as I rang OTELO) Your payment plan is a legally binding contract and your failure to pay constitutes a breach of your legal obligations under this contract.
As a consequence of your breach, an administration charge of £12.50 has been added to your account. Also any accrued interest will also be added back to your account in the event of continued non-payment.
We are concerned to understand why there has been a problem with the payment. If you consider that you have a valid reason for non-payment, you should contact us immediately so that details can be entered onto your file, which will allow us to remove the additional charges that have been added to your account.
To discharge your liability you need to make payment direct to this office.
If you have already brought your account up to date since the date of this letter, please contact us immediately to confirm the payment method and date.
Do not ignore this letter. You should act now by calling one of our advisors on 01932-332002.
Yours Sincerely
etc
Any idea's on what to do? Do I go back to OTELO? We are moving house next weekend should we notify them of our new address?
Any help/advice would be great!

Nope. All it has proved is that they don't have any real paperwork to back up any claim that you owe something.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

I would sit there and if they get fidgety, I would just remind them that you are still awaiting the promised statements. Or if you have never dealt with Hutchinson, I would just tell them that.Does that mean that we don't need to do anything?Hi, we’ve had to remove your signature.
