Help please, sold an ipod but because it made a noise they want money back

Sold an ipod a few weeks back. It was my brothers, brand new in sealed packing, here is the email I have just recieved, please can you offer advice
I was very pleased with the purchase of the iPod video that i purchased from yourself on ebay about a week ago (i have attached a copy of the receipt) but, yesterday i turned it on and it made a weird noise and only half of the screen is working. I tried resetting it but it is still the same.
Could you please contact me to arrange a replacement or full refund.

Have you check the same ipod has the same serial number as before?. The buyer could easy have swap the ipod for a non working ipod.0

Just tell him that the sale is final. He has no proof that it is the same machine, he has no proof that he did not damage it and he has no proof that it is even faulty at the mo.
Tell him to contact the manufacturer, it was sold by you with no guarantee implied.

If it was bought from the apple shop their receipt should show the serial number.My TV is broken!

Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
If the buyer paid by paypal though he might win a claim for damaged or broken item received in which case you would have to accept the ipod back and make your own repair claim through Apple.
If you have the receipt or proof of postage then could you possibly help your buyer make a repair claim though Apple?

Paypal chargebacks have a time limit of 45 days. I believe the ebay system allow 60 days, but I'm not sure.

Ask them to return it. If it does come back then get it fixed or replaced under the manufacturers warranty.
Did you make any conditions regarding the sale ie was it advertised as new and what return conditions did you use if any?
If they don't return it then jobs a good un.You cant take the trousers off an elephant!0 -

I am relucant to offer a return as I have no proof that this was not caused by the buyer, but at the same time I certainly don't want a charge back and be left with no money or no ipod.

Let's look at this from the buyers point of view too, it is just possible they are honest and it really was received faulty.
My approach would be to offer a refund of the purchase price only, when the buyer returns the device, excluding any postal costs in either direction, and subject to your testing the unit and inspecting it for physical damage.
You really need to set up some T&C's in advance, even for your "small ticket" sales.0
