need some help here, please read
Last tuesday i purchased a van thru e-bay, i was the winning bidder etc so went to collect the van tues night. Test drove it, and it seemed all ok. Was only a little bimble round the block. Decided i would take it, so handed over the asking price in cash as it was only £650. Now this is where it get tricky,,, I managed to get roughly 8miles from the seller, when the van just died on me! I had to be brought home by the AA, and the van is now in a garage where it has been since thursday.
What i want to know is, do i have any come back on this? The person seeling the van met me at his place of work where the van was, but i did not by the van thru his work, it was cash to him. But the log book was handed to me with the trade sales bit removed. Can i have him done for being a trader possing as private seller?
Really un-happy about this, as its my first car and i feel he has just mugged me. If i fix the van it could cost a few £100, or if i sell it as it is it probably worth just a few £100, if that.

You'll need a bit more evidence than a missing piece of paper to prove someone is a trader.

I dont think you have any comeback. You checked the car, if you wernt happy you could of walked away. You could of also got an AA check etc where they will check out the car and make sure everything is ok.
Its a case of sold as seen I would guess.0 -

Yes but was it a van shop or just a cake shop or something similar? Having a shop doesn't mean he is a motor trader.
Sorry to point out the obvious but what did you really expect when you bought a van costing £650 from Ebay. Fair enough if it had been a mate's van and you knew it was old but sound. Pay a bit more next time and get a better vehicle.0 -

It was a car garage yes, not a cke shop or anything, if that was the case the i wouldnt have come on here asking about it!
I expected a van to last longer then 5 minutes weather it from ebay or not. And if i could afford to pay more then i would of, i wasnt trying to be a tight !!!!, it is all i could afford.0 -

I.e. you didn't win the opportunity to test drive it and then decide whether or not to buy.0 -
was it a classified add on ebay or was it an auction? if he is a trader then i would hazard a guess at him selling other cars on ebay.
again a car at £650 is a gamble which more times than not will pay off for a decent amount of time.
but a van at £650 will be a shed, it will have taken some punishment over the years with very little expense as possible spent on it. to find a van at £650 with no trouble or under lying problems will be pretty rare,you will find them but still rare.
as for comback,im not sure,maybe you could post a link to the ebay advert for the vehicle to help others assist you....work permit granted!0 -
Was the eBay ID "Registered as a Business Seller"? if the advert was trade and you brought from trade premises then your covered no matter what the receipt says.
But what you are legally protected for would be minimal on a £650 van, possibly just that it was safe and road worthy may be all you could have expected.

A slight aside from your real point...
I thought if you won an item on ebay you were then obliged to pay up.
I.e. you didn't win the opportunity to test drive it and then decide whether or not to buy.
Morally maybe, legally no.
I would want to drive/look simply to make sure it was "as described"0 -
