  • Were you issued with court papers and if so did you ignore them. If no then you did not have a court appointed bailiff just a debt collector lying to you.

    No we did not receive them. It was proven that the court papers were sent out by registered mail, to the incorrect address (we live at no.9 and it was sent to no.19, who refused to sign for them!)
  • If the SRA was abolished in 2006, is this ticket which has the byelaw printed on the back of it invalid?

    DfT have this Railway Byelaw on their guidance pages of their website and it still includes the line about the SRA.

    So, if it was proven that the court papers were not given to you but were sent to the wrong address, how did you get a judgement issued against you? Did you attend court? Did you win? If the judgment went against you for not turning up did you not appeal as you did not get any papers? I'm a bit confused by the train of events, I'm not having a go at you.
    Normally I would have thought you should be able to appeal a case such as this.

    Looks to me, as you have already said, that this was a bailiff being uneconomical with the truth. If the court thought he lived at 19 then I am sure their bailiff would call there.

    In any case, any Bailiff who would be happy with #130 would have to have something to hide ;)

    Just how many tickets are you referring to in the first post? If its as many as I imagine then you should definitely go to pepipoo for help. Normally the ignore advice is sound but for a """serial offender""" (hope you don't mind me calling you this) there could be different advice.

  • I park there daily and the carpark charge is £7.30/day. I am registered to the NCP FastPark service and pay the charges for parking using this service.

    In the last 3 months or so, I've found that despite calling the service, receiving a confirmation at the end of the call that the charges have been taken directly from my account and that my parking session has started, I get back to the car in the evening to find that I have a ticket.

    I certainly not offended that you called me a serial offender - it sounds quite comical actually :rotfl:considering the circumstances.

    In the last 3 weeks, I have received 8 tickets, despite the confirmation on the phone that the parking session had started. (and checking my email in the evening - no confirmation of the session!).

    I've spoken to the parking attendent on site about this several times but he's as thick as two bricks and just said, "you weren't displaying a ticket love"...

    I really do need some help here!

    I'd never received a parking fine before this incident and had never dealt with a baillif before - it was way before I knew about this site and way before what I know now - I thought I was in the wrong for ignoring the parking fine so I paid mr baillif to get rid of him!
  • From what you say you unfortunately fell for their story about being court bailiffs and paid up, just as most of us would have. Now with so many I think you should also put this on pepipoo.com, they may feel its worth pursuing this and it would be sensible to get another perspective.

    Tell them the whole story about the previous ones as well - I reckon you paid a Debt Collector not a bailiff, which was norty of them to mislead you.

  • A thought for the OP, can you confirm from your bank statement that NCP have taken the correct amount and on all the days you parked there?
    If so and you have already paid some at £25.00 a go then you should be able to get the """Fine""" back from them even if you have to go through the small claims court.
    Maybe someone could confirm I'm not talking out of the top of my head.
