  • Hi hope someone can help. I tried to reclaim bank charges for my brother on the grounds of hardship. He is unwell and has lost his job. Lloyds TSB replied that at the time of the bank charges he wasn't suffering hardship so the charges were fair. Does anyone think it is worth writing back to Lloyds or going to the ombudman with this. kind regards

    Just a little success story I initially contacted HSBC in Sep 2010 regarding charges applied to my current account and loan when I initially entered a DMP in 2005. I had an initial response in Oct 2010 stating they believed all charges were correctly actioned, I responded saying that I believed that they didn't stick to the banking code which stipulates then should be seen to assist with financial hardship individuals. They again responded with sorry but we believe we have charged you correctly and it would be their final response to the matter.
    In Nov 2010 I sent a third letter to HSBC (stating that i was escalating my complaint to FOS) and a complaint letter to FOS with supporting docs and letters from myself and HSBC. In DEC 2010 and JAN 1st 2011 I received letters from FOS stating they were looking into my complaint and awaiting contact from HSBC. On JAN 22nd 2011 I received a letter from FOS stating that though the bank had no obligation to refund charges, they agreed with myself and FOS that their refusal to cancel a DD from my account for their loan was unreasonale when it was obvious there was no money available to pay it and the charges had accumulated and accounted for £400 worth of charges and debt and that they would refund that amount.
    So I should hopefully get the cheque very soon, not the full amount but a unexpected win fall considering I took this on expecting nothing.
    A Big thank you to everyone on this site this refund along with the advice on F+F this past 12 month mean my wife and I have got rid of £8000 worth of debt on a DMP to £0 ad start 2011 with no debt and a move down south. It was only possible through the help and guidence from people on this site.

  • Well, today i got my letter back from Halifax saying they are not going to give us any of the money back for the un-fair bank charges. Supprisingly, they are giving us a £35 'good will' payment!!!!! I rang and told them we are not settling for £35. Off to the ombudsman for me! Eeeeeekkkkk!

    Hi everyone

    I am looking for a bit of advice. I am on a Debt Management Plan and have been for the past 7 months. I was wondering if it would be beneficial for me to try and reclaim the charges that the banks & credit card companies have charged over the previous months. My only worry is that it would jeopardise my DMP as the banks and credit card companies have either frozen all the interest or reduced it to assist me and if I apply for charges to be deducted from my debt they may in return apply interest.

    Has anyone applied for charges to be refunded whilst on DMP and what impact did it have on your DMP.

    I hope someone can answer this question.

    I have tried to reclaim 3 times now from RBS. The amount I have tried to reclaim is over 3500k! 3 times I have been told no. Not long ago I got a letter saying they were taking £250 off for charges for one month. I though that was ridiculous so they said as a gesture of goodwill they would take off only £150. I accepted this as I could not afford £250, I could not even afford the £150 so have ended up with more charges. I then went about trying to reclaim for a fourth time as I am not one to give up easy to then only be told by RBS that as I accepted a lesser charge I gave up my rights to reclaim! Is this true? I first started getting charges after I left a very troubled relationship with our child and ended up with debt from thanks to my ex. Do I give up or keep trying?

    Have you read the article on the site, about going to the Ombudsman? Give that a read and it'll tell you the right way to go through.

    Hi. I have written to Santander (Abbey) using all of the template letters and have been told that they are not going to pay back any of the charges. I have now written to the Ombudsman. They have replied to say they are now writing to my bank. Will update again when I hear the result.

    DS1 heard from the ombudsman that they uphold the charges on his Halifax account as a result of the court case and he will receive nothing back. He is going to come to an agreement to pay charges back at probably just £1 a month as he has no income. They are going to lose out in the long run anyway. He accrued charges of £550 over a few months for going under £5 over his limit of £100, and it was their new charging structure that caused him to go over.

    DS1 has left uni because of stress caused by the financial situation caused by these charges.

    Having been 1 of many that had their original case put on hold till after the court case, I decided to continue with my claim against the Halifax.

    Since 2001, I have been charged over £13,000 worth of charges, nearly £4,000 of that has been since 2007.

    I was contracted by the Halifax last week as they wanted to verify a few details, and was told they would contact me again early this week.

    Well today the phone call came and I was offered £898 and a further £50 for the stress of getting constant phone calls from them which usually start at 8am and finish at 8pm. They said they were prepared to pay back charges from the end of Nov 2009, which is the date I left the Armed Forces!!! Coincidence????

    So as you can imagine I will be contacting the Ombudsman!!!

    13k geez tahts alot of charges what on earth do they relate too ??!!

    anyway i have started my own claim from trnasactions in 2007 i went over my over draft limit by £5.50 and got hit with a total of £90 which was basically works out over the 17days i was over my overdraft limit a staggering 60,000% per year if it was converted into an interest rate
