    I am looking for some advice. I have had untold amount of charges from Barclays from going over my overdraft limit whilst I was at University as I my outgoings continuously exceeded my incomings and I was in a cycle of getting over of my overdraft limit, getting paid and being back within my limit and then falling back beyond my limit. Not only was I being charged for initially going over I was also incurring a £22 charge for every 5 days I was within a reserve amount (something which I dont ever remember to agreeing to initially).

    Since then (September 2009) I have been working full time and whilst in theory I am earning more than I need to pay I have still regularly fallen beyond my overdraft limit and incurred more charges. I am currently in a position with a £2000 overdraft and a £2000 credit card which I can afford to slowly pay off. Is it worth my trying to claim based on the financial hardship I faced whilst I was at university? To say I wasnt very good with my money (at the time or since to be honest!) would be an understatement...

    Not sure of anyone else has a similar situation to me but around a year and a half ago when all this bank charge stuff started to become big news I decided I wanted to try to claim back my charges from my bank (HSBC) but as I didn't really understand how the process worked I decided to use a company I found on the Internet to do it for me. They were called 'financialclaimsuk'. They were in the middle of getting my money back for me when the test case happened, since the ruling of the test case I've not heard anything from them nor does the business appear to be running! Does anyone know if I can carry on my case on my own without them? Or know of a phone number I can reach them on

    Any help would be appreciated!

  • Hi, I had been a customer of HSBC for twenty years, taking home a good monthly salary, when I was made redundant in 2003. I very soon afterwards suffered a complete breakdown and have been unable to work since.

    I have incurred costs for going over my overdraft regularly since then and first asked the bank to consider repaying their over the top charges about eighteen months ago. They of course refused, the last contact I had with them was a letter in December '09 and a telephone conversation February '10.

    Because I still suffer with depression, I don't always feel up to taking on this battle, but having found this forum, it has given me a bit of a kick and I really feel that I should make another attempt. My claim is based on hardship and the fact that I am forced to live off and sometimes go over my overdraft. Any advice gratefully received!:)
  • Have followed Martin's advice to challenge charges of £310 that Halifax made on my girlfriend's current account when she accidentally went £16 overdrawn.

    After several rejections from the bank itself, we got a letter from the Financial Ombudsman today stating that Halifax is offering £350 in full and final settlement.

  • Following a 2 and a half year wait, i today received a full refund of all PPI charges added to my Lloyds TSB credit card incorrectly. 6668 pounds refunded to me and a great deal of satisfaction came with it. For those still waiting, stick with it. The system does work and you will come out a winner. Good luck to all those still awaiting an outcome and thanks to all those on here who offered words of encouragement and support.

    Also sad to hear that the FoS upheld your complaint almost a year ago and you've only just got the money ... but at least you got it in the end, including the £200 compo awarded I hope :)

    Amount claimed: £625.57 (including interest)
    Amount paid: £846.45

    I claimed in August 2010 and receved the standard long winded reply basically saying they would not refund the charges. I thoght about it for ages then wrote to them at Christmas, just a few lines saying briefly, but politely,that I had considered their response but as I thought I had a strong case I would be referring it to the Ombudsman. I received a letter this morning saying they did not accept my complaint but would like to make me a full and final settlement offer of £846.45!! Plus no charges to my account for the next 3 months. Needless to say I have signed the acceptance form and it is in the post already. What I am expecting however is a futher letter cancelling my overdraft facility which just happens to be £850. So, my overdraft paid off, one less debt to worry about, a good result all round.Thank you Martin, I couldn't have done it without your help and good luck everybody with your claims.

    I just wanted to say a big thankyou to money saving expert. I found out last week (Thurs) that i have been charged over £500 worth of bank charges in the last six months. I wrote a letter to Halifax using the online templates and stated that if i didnt hear anything in 14 days i would request a refund for 6 years worth of charges. I have a phone call today from Halifax who have agreed to pay me £420 plus write off the £100 which was due to come out of my account this month.

    When on the hone to the halifax, they did mention the so called 'bank case' but when i insisted i understood about the case and would still making a claim, the lady on the phone just agreed to pay everything back. I am sure that if i didnt send your template id still be upset about charges . At least now i can clear my overdraft.

    It pays to be patient and it goes to show that the customers of the banks can win.

    I have been looking to try and find some success or fail stories for Yorkshire Bank, claiming under financial hardship?

    Anyone know what their policy is on this

    I have a cccs counsellor preparing a supporting letter to send with my hardship claim as they have charged me about 5k in three years.

    Bank: Lloyds TSB
    Reclaimed: £359
    Amount Repaid: £195

    I sent a letter just after christmas asking to reclaim my bank chanrges. I went back into full time education in Sept 2009 and have struggled since then. Lloyds have just replied saying they don't agree that they did anything wrong but that they're willing to refund £195 anyway. I'm not sure if I should hold out and go to the Ombudsman for the full amount, the only reason is that my monthly income is only £385 so the remaining amount is a bit significant to me. I don't know...
