Help! Comet won't refund faulty satnav

I have a satnav which I bought around 2 months ago. It is a Navman F40 and has numerous faults. The onscreen keyboard constantly ignores keypresses despite the voice actually saying the letter (it just doesn't go into the search box).

The M25 is not correctly understood by the satnav so every time I set a route which would logically take me down the M25, it routes me off at Maple Cross, and makes me rejoin after Denham. If I ignore the instruction to leave the motorway at Maple Cross, it just says my route can not be calculated from this point, and I have to wait until I get to the M40 junction before re-keying in the postcode!

Also the satnav does not warn of any speed cameras despite being set to warn.

I have checked all settings and even reset the satnav to factory mode but still no use.

Problem is Comet say they must send it away to have the fault confirmed by Navman.

I cannot do this as I need the satnav daily for my work. It is definitely faulty and I want to get a refund and buy a better satnav by paying the difference.

I can demonstrate the fault by setting a route which will not work, but I am hitting a brick wall because the store say they have to return it to the manufacturers.

Can I insist on a refundwithout it being sent away??

    Sale of goods act states that faulty goods can be rejected for refund if faulty. I will not be accepting a repair in any case.

    My question is whether they can insist on sending it away to have the fault confirmed by the manufacturer. I would not accept a repair as I purchased a product which should not need to be repaired!

    I am actually spot on you idiot. If you read part of the SOGA its pointless.

    You can reject goods within a reasonable time and inspecting for a full refund if they are not as described. 2 months down the line is not reasonable time for rejection as if they were faulty at sale it would have been obvious the first time you used it hence you should have rejected it then.

    Therefore after acceptance the SOGA allows you a repair, replacement or refund (partial) at the retailers discretion. You have no right to insist on a particular remedy.

    Hence if Comet want to send it off to Satman to repair it or replace it they are entirely allowed to do so.

    You are only entitled to a refund if this is what Comet choose to do.

    As for repairs/replacement. They have a reasonable time to do so. For a small electrical good I would suggest 14-28 working days would be classed as reasonable.

    Only entitled to refund if it is faulty, Comets refund process might require it to be sent away so this can be validated.
    In this case it is sending it back to Navman.

    Buy a Garmin next time ;)

    Funny enough hte Current SOGA actually the supply of goods and services law, says 6 months for a consumer and they do not have to prove it was faulty at time of purchase. So you are wrong yet again.
