ESA failed medical, how many others have here

I failed the ESA medical which only lasted 20mins and was a farce. How many others here failed this and now having to appeal? I just wondered?

give the community legal advice a ring , they helped me a great deal to prepare my appeal against their decision and go to the tribunral

OP, you are not going to get an accurate representation by asking the question that you have. People rarely post just to say 'I passed', because they do not need any further help. Therefore your responses are going to be unrealistically skewed in one direction.

If you have specific questions about your appeal, feel free to ask them. If you feel that you need help with your appeal, you can contact CAB or CLS as suggested by symikins.

symikins, glad to hear your good news. ;)

  • It seems that I am the only person who had a nice ESA medical. The doctor was lovely and was very apologetic that I had even been called in for the medical. After reading on various forums about the hoops that people have to jump through in order to pass the medical I was extremely worried, however I neednt have been as the whole ESA Claim for me has been relatively simple. Im now in the support group and will have to have another medical in October 2012.

I too had a simple and straight forward medical, the doctor told me I should have requested a home visit and I said that I go for a coffee once a week and to hospital appointments and did not want to misrepresent myself by not attending the medical at the centre.
I had the results within 3 weeks and I am in the work focussed group but do not have to attend any of the interviews for the next couple of months as I have a lot of treatment coming up.
I took with me to the medical a file with my care plan in from social services and reports that were recent from the hospital which he went though and copied.

Thanks for the number, No I was not given this, probably cause they dont want people to pass it so give as little help as possible.

Well I scored 0 on everything, but none of it addressed my actual problems at all and I must say that the medical person I saw was a load of crap, she sat there asking me questions on the pc and I had to answer yes or no and that was it.

She asked what hand did I write with? What did I have for breakfast? I said I sometimes eat early and sometimes dont, she said you cant say that, you have to say either yes or no cause thats what it states on the form. She asked me what programs I watch on TV and which ones did I prefer. She was one of the worst medical people I have seen to be honest in my life. She had no idea of my problem and didnt even address it.

I felt like I was on some school test to be honest and if I answer the question wrongly I will be penalised for it, or fail the exam. The medical lasted less then 20mins and was rushed and then I was shoved out quickly for the next person to go in. Anyone could have done what she did to be honest on just asking a load of questions on a computer to a person and getting them to say either yes or no to it.

I took all my medications up there as well and even letter from the hospital about my condition and the treatment I was having. They dont even bother checking up with the hospital do they or anything. She saw I was in pain in the medical as I could not do the things she asked me to do.

Well thats what happen with me anyway.

Here are the latest DWP statistics for ESA:

    * Of all ESA claims in the quarter from March 2009 up to the end of May 2009:
o 5 per cent have been assessed by the WCA as suitable for the ESA Support Group.
o 12 per cent have been assessed as suitable for the ESA Work Related Activity Group.
o 38 per cent have been assessed as fit for work.
o the remaining 45 per cent either left ESA before the completing the assessment or the assessment is still in progress.

How long did your appeal take?

    and

Did they stop your money while the appeal was going through or did they still pay you?

Appeals usually take 3 to 6 months.

Once you put in your appeal you can claim ESA at the assessment rate.

Problem is that if something goes the applicant's way then it is fine. If it doesn't then it isn't fair, a farce etc.

Perhaps people really aren't as ill as they think they are.

It was interesting that almost half of ESA applicants stopped claiming before their WCA if I am reading the stats correctly. Now did they recover, find a job or did the GP not issue any further certificates I wonder.
