sold new phone-buyer says its been used?

Sold a nokia 7600 which i had new from amazon and had never used it.Customer says the phone had an entry in the phone book and a video clip of a woman exposing a breast on it(which has now been deleted to stop his kids seeing it).
I have offered him either a £20 refund,a full refund or replacement if he sends phone back(all postage costs covered by myself) but in instances like this-how can myslef or the buyer prove whether it was brand new or not???
had the usuall i will report you to ebay/leav bad feedbak for you unless i come up with someway to re imburse him for his troubles-have i done all i can by offering him what i have-or could it be somebody just trying to con a bit of money back from me?If anybodys had anything like this happen b4 id like to hear how you dealt with it-cheers

hmm, hard to prove it if they've now deleted it from the phone - have they also removed the entry in the phone book??
also, was the phone sealed when you got it/sent it?
i wouldn't bother giving them any money off but would rather get it back, hand out a full refund and sell it again (remembering to add them to the list of ebayers not allowed to bid on your auction just to make sure)0 -
Never had anything like this before but if you have offered a refund including postage if he returns, what more can you do. You may be right, he may be trying to con you. find it hard to believe a new phone from Amazon would have a picture of a breast on it.
You may have to be firm and just tell him that you have offered all you can and if he leaves neg feedback you can counter it be saying you offered full refund which was refused.0 -
Ignore the buyer. Check his feedback to see what its like. State the phone was new when sent. Chances are he got it and didn't like it, and is now trying it on. Take the negative if he gives you one, and put your reply to it.
Ebay won't care, as the phone was delivered, so he has NO recourse with either paypal or ebay.0 -
yep i agree with above youve done all that could be expected by offering a full refund inc p&p(a lot of sellers wouldnt have offered this).my guess is he doesnt like the look or feel of the phone(they are ugly but he can see that in pictures or his local store so thats his problem)i know the amazon 7600s are definatly brand new.i woudnt offer the £20 refund,just stick to the return or keep approach.0

Yes, definitely sounds like a con artist to me, although is it a bit of a strange story to make up!
I would cut your losses and give him a full refund and get the phone back. Relist it immediately and hopefully you will still get a decent price.
Unfortunately with EBay sooner or later you will encounter someone who is not happy, you're best trying to resolve things peacefully otherwise you'll have negative feedback wrecking your account.0 -

What has been said previously is right - you have done all you can do to resolve it now. I would not offer him any money though, either keep the phone or have a full refund upon return of the phone.
Did you buy the phone from Amazon.co.uk directly or Amazon Marketplace?

Although I don't support your buyer here, is there any chance that the phone was a return to Amazon and got sent out to you by mistake?
I agree with the advice above to refund and get the phone back, but is this a possibility?
You could explore it with Amazon e.g. 'I bought the phone as a gift and my friend said that there was this picture etc etc'
If that is the case you then have grounds to return it to Amazon and get a new one.I'm so sexy it's a wonder my underpants don't explode.0 -
.Sent him another email late last night-stating my suppliers had been imformed and they want the phone sending back to them.Also said dont worry about the picture you deleted-they have software to view deleted files on the phones
.All im offering him now is that he returns phone to me-il pay postage and send hima new one with a few payg sims with £15 credit on them-no money reinbursement now being offered-awaiting his responce.
