It would depend whether the trust that she was managing gave her the discretion to do this.

If so, I suspect it is fine, as long as she then registered the child's interest in the house with the Land Registry and make explicit what percentage of the house they own.

Then at a later date, she would have to buy their percentage out, at the going market rate.

You also have to balance the value of the money now against the possible value of the estate later with regard to how much upset you want to cause.

What gets more complex is that it may be that the house gets sold to pay for care, through equity release, or she does not leave you the house if she has not made explicit provision for the child portion at the land registry.

I am going to go out on a limb here and say that no interest was registered with the land registry and they have moved house since the original one was purchased so again it makes me think that there is no record of this money.

I am getting a copy of the will, how would i know if the trust set up gave my mother the discretion to do so?

Just wait till you get the will. Things will become clearer.

A more interesting question is whether there is a public record of the accounts for winding up an estate. This will give the starting point for your inheritance, against which you can check whether the will was correctly executed and against which you can ask for an account of the conduct of the trust to present.

This effectively is the watershed for whether the executors did their job correctly and whether the trustees did their job correctly. Don't jump to conclusions that one or other is at fault just yet

Where might I find such accounts if they do indeed exist?
  • quick update, been the bank and obtained copies of my statements from around my birthday, the amount that was transfered to my account was £3.5k now I know I purchased my parents old car (£900 for a proton hatch, I was done, and also a comp for £500) that is a total of £5k. Unless I am missing something there is a rather big difference between the house value between 6 of us and £5k.

I will update more when I receive a copy of the will.

P.S. it is surprising the amount of rubbish you buy when your 18!

No idea, sorry. But it is the document you need to see.

Don't have any more to add to the help you have been given already, but will be interested to find out what has happened

'Personally', I would want to know for peace of mind, and if money has gone AWOL I would be wanting an explanation from my mum.

Good luck with the investigating xx

That is the reason I want to know, if there is a logical explanation then fine but if i find otherwise how do people advise i approach the subject??

Burst in a call her a theiving %$^% ??? (probably not the best idea that)

I mean I could really do with £10k, as im sure alot of other people could but i dont no if my parents have got that much kicking around, i suspect not.

My older brother got his money straigh away, i would be interested in finding out what he got but i dont think he'd ever say. (3 of us inherited in my family, 3 are my cousins)

A beneficiary under a will is entitled to see the Estate Accounts - so there should be a set available for you to see.

...only if you want a big argument and the possibility of a huge family rift....

I think you have to work on the assumption for now that the money is already gone. If you continue investigating it really should be with the view to finding out what happened for your own piece of mind.

I would hold off doing/saying anything to anyone until I had a copy of the will and found out what it said. Then I would contact the solicitor who dealt with things and find out what monies were involved. After that I would approach other people who had received money and enquire about the amount.
Then and only then, with conclusive proof I would ask my mother about it - showing her the documents and asking for an explanation (this is assuming money is missing of course) I would make sure someone else was there during the conversation as well.

As I say, if it is gone, it's gone, there's nothing you can get but an apology and info on where the money has gone - if it's invested in their house then it would be nice to know if their will reflected your (and anyone else's) financial input.

I had never even though about going to the solicitor that dealt with the probate as they would be the ones that completed the accounts etc if any were made. Just a shame it is more than 10yrs ago and any documents like that are likely to have been destroyed long since.
