  • yes thats correct dont send another postal order x
  • i thin k we keep posting at the same time lol

you send the cca request, then the cca reminder if they have not responded within the 12+2 and then you send the account in default letter if they still do not reply x
  • It has now been over the 12+2 days since i sent the original CCA request.

So i dont make any mistakes,
Do i post both letters in the same envelope, recorded delivery?
    That would be the :-

    dont need a signature letter
    &
    CCA reminder letter

    thanks

If you do a CCA request, they are not required to provide a copy of the original signed agreement and can just give you a reproduction without any signatures.

I am confused on this one , so whats stopping a bank just sending a generic agreement with terms on it , but no signature , as i was under the impression that would be unenforcable ?

You're mis-reading. I always say they can send a true copy - but to go to court they need the original.... the lender can send a reconstituted copy (legally known as a True Copy' but in order to take action, they need the original.

Ok, question for you, why would a lender go to all the trouble of making an exact replica (legally allowed) if they had a copy of the original? Surely it's quicker to make a quick photcopy...? Right?

Thus we always state that if they send a recon, chances are they don't have the original or they'd have photocopied it, right? lol

LOL , i hear you mate ,and yes , makes a lot of sense looking at it like that , what i was mixing up was the s.78 and the s.127 parts of it...

No, you send everything separately. Ok, laymans terms for you - if the lender does not comply with your s.78 request for CCA then the account enters default and they cannot take any action against you through the courts - see my signature for details....

Basically, refuse to sign (you do not need this) and send the reminder letter a week or so later, pointless responding and then disputing it - give them time, let then dig holes and make mistakes...... just stay calm and send the signature letter - leave the reminder for a week ;)

  • I have one final question before i post off the 1st of my two letters (the 2nd next week as advised by never-in-doubt , thanks).

I dont know if they are doing this on purpose, but they are replying to my letters with different addresses.
Should i send the signature request letter to the original address i posted the CCA request to in Northampton or to the new address on my latest reply from Nationwide in Swindon.

I dont want to give them a chance of anymore delaying tactics.

    thanks for any replies:T

I have had a new letter from nationwide, which says that they are unable to send the CCA to my address as the request letter hasnt been signed.

But, they have sent a copy to my local branch of Nationwide and i can collect it with a form of ID, where the staff will release it after verifying me.

Is this standard procedure, anyone see a problem with this?

thanks in advance, for any replies.
