Urgent advice required.

I bought a iphone on Saturday (if the model matters) from Phones 4U and on taking another look at the contract found the details not to be exactly what I asked for. In this particular instance the Data part was limited to 1Gb where I asked for it to be unlimited. I know this sounds alot and I've been told this by alot of people but I have my reasons for being scepticle. I have once fell subject to charges on text messages and ended up with a bill of over £250 instead of £45 through going over my allocated 1000 messages for the month. So instead of worrying over how much I'm using the data side of things I decided to take the phone back. I rang Phones 4U up and they said they wouldn't take it back as they do not operate a returns policy although when I rang Vodafone and explained the same thing they said as long as Phones 4U rang them they would happily cancel the contract. Vodafone are happy to do this as it is within 7 days of the new contract being taken out. I spent around 2 hours in the store yesterday from where I purchased it after Vodafone told me to take it back there as they couldn't take it back directly. The manager of the store was all be it to keep me from losing the plot very understanding. He couldn't understand why their Head Office wouldn't make a simple phone call to Vodafone Dealer Support and get the contract cancelled. I eventually up and left the store leaving the phone there.
On getting home I rang Phones 4U Head office again with the same response, they do not operate a returns policy so wont take the phone back and wont cancel the contract.
I then rang Vodafone back and spoke to an accounts manager who couldn't undestand it either. He has and will hopefully be ringing me on my existing mobile this morning when I go back to the store to speak directly to the store manager and try to sort it out. But if he can't talk them round I'm stuck with the contract that I don't want now as it's not what I asked for.

What can I do?????????????????? Desperate!!!!!!!!!!!!!!!!!!!

    You appear to have bought this in store, You have no rights to return it oin that case. The only reason you may have to return if if there is no signal at home, and even then you'll have an uphill battle.

    If you had bought it online or over the phone you get a 7 day perios under the distance selling regulations, but as it's assumed you had the phone to play with and the contract to read there and they they don't apply instore.

    All mobile phones have limited internet access, even "unlimited" tarrifs are subject to a fair use clause.

    Sorry but you probably stuck with the contract.

    You dind't buy it from Vodafone, you bought it from P4U, you have to deal with their policy as the retailer, not what Vodafone say. Your contract for the sale is with P4U.

    Probably too many people getting a phone because it's pretty then hating it and returning it. You've never really had any rights to change something you didn't like if it's not faulty. It was always a goodwill gesture, and s the margins in the market have got tighter then so some companies have just gone back to the basics the law requires and done away with them.
  • Puts customer satisfaction right down there in the gutters, I swear I wont deal with them again and even though it's not Vodafones fault as soon as the contract ends I'll be leaving them too.

    To be fair thoguh thom, you should have really read the terms before signing in the first place, or even read it on the website for weither company where ther limit is clearly stated. I fully agree it's a pain thatyou're now stuck with it :o/ but I doubt it's just P4U that would stand by their policy I'm guessing most if not all would do the same in ther current climate.

    1gb is actually quite good for 'unlimited' data. Some companies limit their 'unlimited' to 500mb or 750mb. No company does 'unlimited' data, check out the thread on here about it.

    On what basis do you think you are covered under a returns policy? I'm assuming you sat in the shop, went through it all and signed a contract? How is it the shop's fault that you didn't read it before you signed?

    Is this something you do often? If so, can I pop something in the post to you? No reason to read it, its nothing to worry about, just sign and return the power of attorney document.
  • Thanks for the advice and keep yer sarcasm to yourself flakey as I'm pretty much sick of policies etc toay. I came on here for advice not to be preached to. No I don't do it all the time and no I don't sit there and read through the small print and it's a while since I bought anything that didn't have any form of returns policy. I asked for an unlimited data contract and believed the manager of the shop when he said it was. The reasons for wanting to return it are that if I go over the 1Gb regardless of whether it's difficult to do or not I'm the one that will have to pay for it not Vodafone or P4U hence I'd rather not run the risk in the first place.
