What to do?! What to do?!. No really, What can i do.
Afternoon all,
Basically; as i was cycling past a crossing, the green man changed whilst i was in the middle of the road. Normally any normal human being would wait til you've crossed, but this idiotic woman started driving & knocked a whole 6ft2" of my bike, destroying the front part of my bike. (thank God i'm ok) After looking for any excuse possible, she did a hit & run, wo/ leaving her details.
Reported it to the police, who transfered it to the transport police, etc, etc. After 5 months of waiting & stern phonecalls, i finally recieved a letter saying that they wouldnt take the case further, but they gave me the womans name, her insurance company and insurance number.
What do i do?

If i call the insurance company, will they fix my bike.
Should i use her name to find this woman & confront her.
What?
All i want is my bike fixed.
Thanks in advance, all.

The insurance company will have a responsibility to any third party regardless of whether it's another car driver or not so you should call them and report the incident.
I'm surprised the police aren't taking it further though - pretty shocking.0 -
Sadly it does not suprise me at all that the police are taking no action.
Did you have a witness to the green man while you were crossing?
In any event you would still have right of way over the motorist if the green man changed to flashing amber while you were crossing.
In a convoluted way it helps your case that the car made off.
The police/CPS will not bring a case unless they consider the action would be succesfull beyond reasonable doubt.
In the County Court the judge has only to believe you are right on the balance of probability.
Go for it!0 -
All you want is your bike fixed..........in that case contact the insurance company to make a claim. Do you have any independent witness? You could also make a claim against the woman at the small claims court. Just wondering how much evidence youve got - in case this would turn into (what I suspect it already has) a one-word against the other account of what happened.0

Were you on the crossing, or on the road?0 -
I'd call the insurance company and put a claim in against her. If they're awkward I believe you can jointly sue her AND the insurance company. Saves you any grief if she doesn't pay up or anything like that.0

If you were on the crossing aren't cyclists supposed to dismount and walk across?0

I'm intrigued as to why a cyclist was on the pavements and also why you didnt follow the right process and get off a bike.
I see quite easily how this happened.
Woman sitting at lights. Lights change. Cyclist speeds to make it and bang.0 -
Probably lucky she hasn't put a claim in against you.0

oh, it wasnt a toucan crossing? then actually she can mow you down, legally speaking of course.Target Savings by end 2009: 20,000
