Cancelling order from overseas internet company with .co.uk address

I, unusually for me without researching the company, foolishly placed an order from a company on line with a .co.uk address. I received a telephone call from them confirming the order and it was evident due to the long delays between the questions, that this was a call being made from abroad. Once I realised this I checked on line and the company have a really bad delivery reputation.

I tried to cancel the order on line and it wouldnt let me so I emailed them immediately to cancel based on the fact that they were falsely representing themselves as being a British retailer. Three hours later, they emailed me stating that my order had been reviewed and was being prepared for shipping. I immediately replied that I had cancelled this order as stated before.

They have contacted me saying that the order was unable to be cancelled as it was so far in the process. They are saying that I will have to pay for the return postage.

Where do I stand on this, having written and cancelled the order prior to it being despatched?? Any help would be gratefully received.

    Where is the company based? What is the website address?

    The laws of their country will apply.
  • It is a company called Crazycameras.co.uk who I gather, from their bad reviews I read subsequently, are from the USA.

    Misrepresenting, rubbish! .co.uk means nothing and there is no legal requirement to have certain domain suffix's in certain countries.

    USA laws will apply and you will have to follow there returns procedure.

    What do you expect:confused: You are cancelling an order for no aparant reason (every company has bad reviews). In the Uk this would be ok but you must accept you bought from the US.

    Your "basis" of false representing is tripe tbh so i was just informing you that it made difference and you have only the rights they have given, which in light of things is quite fair, and actually, under uk law, you would only get the same right so why the big huff?

  • No huff, I was actually being polite, stating the obvious and saying thank you but if you want to go overboard about it, feel free. It seems there are many on here who just wish to rant at people so if it makes you feel better, carry on.

    4743hudson is correct in saying that a company can use any domain they chose. Whilst the retailer you chose maybe based in the USA if they are targeting UK customers they can use a .co.uk domain. They probably also have a .com domain aswell.

    Maybe post the sites address up so people can see where they are actually based and give you some advice.
    Also just because you were called from abroad doesn't mean they aren't a UK company as lots of UK companies use 3rd party call centres all around the world, or their head office could simply be abroad with a distribution network within the UK.

    Again without the full details its just guess work, they may or may not have been falsely representing themselves.
    Everyones opinion is the most important.....no wonder nothing is ever agreed on.
  • :oThank you Pitkin. I know I have been foolish and gone against all the advice you get on here! My own camera broke this week and I have a wedding to go to on Saturday so a quick fix was needed. Was just being rash.

    Sorry I completly missed post #3 with the web address in it lol.

    looking at their site it says
    To minimize our cost, we have hosted our distribution facilities in the United States. We can quickly source our products from around the globe and post them to the UK.

    That would explain the phone call from abroad.

    delivery states,
    Deliveries can only made to mainland UK addresses. We offer the following methods of shipment

    1. Standard: 5-7 working days, (up to 30 working days in extreme circumstances)
    2. Expedited: 2-3 working days
    Have you received the item yet?
    As for what rights you have I can't help with as I would have thought it would be USA rights thats apply and not UK rights.

    All I can say is if you were happy with the price you paid I would continue with the order, obviously if delivery becomes a problem and you haven't received it fairly quickly get back to them and see what they will do.
    Lesson learnt lol, next time double check where your goods are coming from.

    As for online retailer reviews, as long as everyone isn't screaming scam most reviews can be taken with a pinch of salt and a little common sense. Take a look at the play.com reviews a lot of people are complaining about their CS at the moment but people only generally go to a review site or a forum when they are having difficulty with something and want to vent, people just don't always bother to praise the good but quick enough to discuss the bad.

    Good luck and hope it does turn up. Maybe someone more knowledgable with legal side of the USA returns policy may offer more advice.
