Help, Dads been refused DLA - should i appeal?

  • I agree with Mojisola, you are doing a great job supporting you dad.

I can understand that you would be nervous talking at a tribunal. It may be worth looking in a advocate service so that if it does get to Tribunal, an advocate can speak on behalf of your dad. When you contact CAB or DIAL they may have information on local advocate services.

I am saying "if" because when you contact the DLA they may do a reconsideration which doesn't involve your dad having to be in front of a tribunal panel.

    Best of luck.

Thanks guys, I really appreciate the support,

Just a quick update, I called DIAL today and they've put me in touch with Welfare Rights in my area and had a quick conversation with them and they said they will be able to help but there going to call me back later this evening with advise and the next procedure,

so looks like its going well so far but i will keep you updated.

    thanks again

I don't agree with all this translator stuff........but.......your dad is very lucky to have you looking out for him :)
  • I had to go to appeal 3 times before I got it. Keep going. I think they refuse most people first time round, just because half the people won't bother to appeal. It saves them cash!!!

    thanks for the reply,

Yeah thats what i'm beginning to think about them refusing most people,

anyway a quick update, i've got in touch with welfare rights and they've put me through to CLA and they will be helping with the appeal,

sent the appeal letter back to the DLA office and just waiting for a reply now,

    will keep you updated.

Always always always appeal. That's the only advice I have. Most appeals are successful. You get a chance to speak to them face to face. As said above there are plenty of ways to get a translator.

    Hello again,

Just an update, we contacted CLA and sent in a letter to DLA office stating we are appealing the decision, We received a reply a few days later saying they are looking at the case again,

then today we received a letter from DLA say they have looked at the decision again and that they WILL be awarding my dad the mobility component (higher rate) and the care component,

Thanks to everyone for all the support and advise you've given, I really wouldn't have been able to do this without you!, I am truly grateful.

I've seen that some people can get extra support like bus passes/ disabled badges/ winter payments etc if there awarded DLA, is there any more information on this?

Thanks so much people and if anyone else is in the same position then my advise is to definitely appeal the decision.

    1. Can you not interpret?
    2. Can somepme he knows do it for him?
    3. Can he pay for his own translator?
    4. Best of all, can he not learn English to a standard where it isn't a problem and then reapply?

Did you read about the drain translators are on services?

What an appalling and disgusting thing to say, that is not helping the OP it is just offensive. Health professionals do not like using friends or relatives for translation for a start. But the rest of your comment is plain ignorant and rude.

Anyone on higher mobility is entitled to a blue badge. Your dad just needs to fill in a form from the council and send his award letter off.
