Help, Dads been refused DLA - should i appeal?

    Yes i believe the timescale stated on the letter says 28 days, However I received the reply from them yesterday,


    After reading the comments here i'll first get in contact with CAB and DIAL and if they advise to send the form reconsideration then i'll do that first.
    Is this the right step do you think or should i send the claim back for reconsideration and then if it is denied again then make a formal appeal?

    In regards to the question about the form being filled in, the form was actually filled in by a friend of my dads, my dad gave him the information and was sitting beside him when they were filling in the form.

    From experience, many people with needs learn to adjust their daily living so that they don't always realise how their illness affects their lives. A good advisor will ask the right questions to find out just how the claimant's life is different from normal.
  • Go for the appeal! I had help from DIAL (or A4U depending where you live). They dealt with all aspects of my appeal - which was vital as I couldn't have spoken for myself at an appeal (not even answering questions!)

    thanks for the advise, i'm going to contact DIAL and CAB first thing monday morning,
    I'll update this thread on monday when i get a bit further with the cab and dial.

    my dad doesn't speak very good English so i think it would be quite hard for him to go through a tribunal by himself, can any organisation members or someone on his behalf plead the case?
    1. Can you not interpret?
    2. Can somepme he knows do it for him?
    3. Can he pay for his own translator?
    4. Best of all, can he not learn English to a standard where it isn't a problem and then reapply?

    Did you read about the drain translators are on services?

    If u cant get an app with Dial or Cab do a google search for an "disability action groups" in ur borough and they will be able to help you.
    I did this for my dla and got some fab help and advice.

    I had to reapply for my daughters dla, she was on higher rate care and lower rate mobility. They then decided she was not entitled to anything so i appealed and went to the tribunal just me and my daughter, i took along a diary detailing a typical week and the care my daughter needed and had it photocopied for each of the panel members which consisted of a disability lawyer, doctor and a carer. I did admit to being a scared but i went and explained everything and the decision was overturned and she had her dla reinstated. Do you live near your dad? if you do could you go to the appeal with him and explain things?

    I wouldn't mind going with my dad but to be honest I would be really nervous if i had to speak to the panel, i do live with my dad i'm only 16 years old so i don't know if they would let me speak on his behalf?

    I've done a quick search for cab and dial and they have offices in my area (Leicester) so i'll see what they say first then take it from there.

    also where is the tribunal office located?

    Well done! You're great to be doing stuff like this at 16.:T

    Once you've got this settled, it would be worth asking in your area about a young carer's group. You will get a lot of support and help from them - and a few fun days out as well.

    My son had to go to a tribunal when his claim for IB was refused - using basically the same information we gave when he was awarded it as nothing had changed! One of our council's Welfare Officers came to the house, filled in all the appeal forms and then took him to the tribunal and stayed with him throughout. When my son struggled to answer questions - he grew more tired and brain-fogged as time went on - the advisor was able to answer for him. It would be better for your Dad to have someone like that with him.
