Council tax and 2nd person

    Please can someone confirm (sorry, I'm just trying to understand this thread).

    If one adult is on IS and receives DLA including Care component, are you saying that there will be no council tax liability if another adult moves in who is non-dependant? But if the original claim is based on the person who is also claiming housing benefit, surely the non-dependant would be liable for the council rent? (if not any council tax)?:confused:

    I have no idea, but would have thought so???

    You still pay councl tax as normal, you can apply for a band reduction but it has to be for another kitchen or bathroom solely for the use of the disabled person or be for a bigger house because they are fulltime wheelchair users

    Heres the rules and you will see that you can claim a band reduction only unless you have severe mental health issues.

    The liable person has to receive DLA care at any rate for there to be no non dependant deduction, the claimant does have a liabilty but receives benefit to cover the charge

    The non dependant isn't liable for rent or council tax as not the tenant/home owner

  • When no Non-Dependant Deduction is made:
    No non-dependant deduction will be made from Council Tax Benefit if the claimant or their partner is:
    • Registered as blind or having regained their sight been registered as blind in the previous 28 weeks OR
    • Receiving
      • Any rate Care Component of DLA
      • Attendance Allowance at either rate

    I just wondered, I don't think my sister gets full council tax benefit, would it count for her too, she lives with her husband and is on just low rate care high rate mobility. Does 2nd person count if they are a husband?

    Also this Customer Information System that the LA can look into and see a persons dla details does that mean they can see the details of why you get it and all the personal info or just that you are on it. Unless the customer service details are not up to date for me because she did say the only thing they had on me was that I'm on income support. I just don't like the idea that my personal details can be logged into by any LA employee

    this was exactly the problem and outcome we had when my ds started work,even when sorted out they still tried to insist on seeing his wage slips,i told them in no uncertain terms that as his earnings made no difference they could sod off !;)

    Well the info the supervisor requested is

    2nd persons full name and dob, relationship to myself, date moved in and previous address signed by myself and no wage slips needed plus evidence of my benefits in letter from benefits agency to prove my dla

    I did ask her if she could get the evidence by contacting the agency direct but she said no

  • Can't you request a letter of entitlement to DLA (DBD384) to prove that you're on the benefit? This is the same letter that local authorities and transport authorities request as proof of entitlement.

    CIS is a system that Local Authorities share with the Jobcentre. We can see Tax Credits, Income Support, JSA, SRP, CA and DLA. It would show that you are in receipt of DLA Care component, what rate and the reason (for example, mental health issues) but no real specifics.

    I can see why you would be concerned but trust me, all LA employees have had to sign a lot of paperwork to say that they won't misuse the system. We are test checked on a regular basis and it is written into our contracts that we can be dismissed if we access any accounts we are not meant to for example, Tony Blair or Gordon Brown. It is a very secure system and does make awarding benefit much faster for all concerned.

    If you ask the LA to check CIS for your DLA award, they can do it that moment and I often check CIS when someone is on the phone.

    As for the information for your daughter, if you don't provide what they ask for, they would use the maximum non dependent deduction but if you did provide just your DLA proof (must be DLA Care for no non dep deduction), this wouldn't affect your award.

    2nd Adult Rebate doesn't seem applicable for your sister as you can't claim 2AR for your partner. When a claim for Council Tax benefit is made, it is as a household so a couple's circumstances are included.
    I currently manage a Housing Benefit service and have been working in Housing / council tax benefit (as was) since 2001.
