Can I suggest that the next time they call you remind them that it is an offence to hassle a bankrupt for money. Give them the ORs number and tell them to call him.
Hopefully the letter from you and call from OR will stop it though0 -
And that trying to obtain money by menace, or claiming you must pay that which you are not liabe to pay, is actually a criminal offence;)Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all ………….

Thanks all!
I did tell them that they are breaking the law, and he kept saying well I can't talk to you about it, and I pointed out that as it was my phone he was calling I thought he should, and as they got that number through underhand means and I told them that under no circumstances were they to use that number to chase for the debt and only to confirm that the fax was received that they were in breach of that agreement, he said they won't remove that number and they will continue to call it until it is sorted.
I will get that letter printed thanks Magpie, and get hubby to sign it, it has to be worth it.0 -
So today we have a letter from resolvecall - who have been instructed by Mercers - what is wrong with these people?????
I am so angry I am shaking, if I lived closer I would go to their office I truly would, they know we are BR, I know that our OR has written to everyone as we are not being chased by anyone else, even egg have stopped the account as at the BR date.
It says we may get a doorstep collection agent, well you know what, I hope we do, I will invite them in, give them a cup of tea, and then show them all the BR papers and ask them to give me something in writing to say that they will not pursue us any more.
I am sick sick sick of them... these people are what gives DCA's a bad name.
Rant over, dh will be home in a bit he is off today due to his shifts, so I will get him to call them and tell them to stop, now.
Where are the really good letters which have been done before?
thanks!
Here's an idea, and it's completely legal.
Type up a menu for a tea, coffee, mineral water, biscuits and cake with extortionate prices. Head it with the name/number of your house followed by 'cafe' and affix to the wall of your lounge (doesn't have to be larger than an A4 piece of paper).
Design an invoice template for your cafe and print off a couple of copies. Meanwhile, arrange a tempting display of cake and biscuits on your dining table.
When he calls invite him in and offer him a drink by saying "what can I get you, Tea? Coffee?" If he says water make sure you serve mineral water. Place the chosen beverage by the biscuits and cake and sit and listen politely whilst offering him further refreshments.
Next, excuse yourself for 2 minutes, tot up how much food and drink he has consumed at your outrageous prices and present him with the bill (works best if you give a free chocolate mint with it).
Finally, watch his face as you thank him for his custom;)0 -
That's the letter done, not signed by hubby, decided that was too dangerous!!
I have put in a copy of the BR order as well for good measure, going out for a walk in a mo so will pop it into the post box, will keep this thread updated as and when or should that be if? anything happens.0 -

So we had a letter today from Barclays Partner Finance, who the debt was with before it was passed to Mercers, in response to the complaint letter.
It starts of well, saying they will pass the complaint to a dedicated complaints person, and that will be in touch within 15 days etc etc.
BUT, the third paragraph has left me incensed, totally, the letter was of course complaining about them constantly chasing us for money right? So the letter from them includes the paragraph: Whilst we sympathise with your situation we must insist that you continue to pay as per the terms and conditions of your agreement until we have looked into your complaint fully
How flaming stupid is that? and it isn't a standard letter either, you can tell as she has had to sign it and has had trouble with her pen.
So even when they have received the complaint, and another copy of the BR order, and the OR has been in touch with them to tell them to back off, they still have to add in, you must pay or else comments.
This has now made me more determined than anything to make them pay, grrrrrrrrr.
Will update as and when anything else happens.0 -
Amazing, barclays closed our account last year for £900 overdraft, were hassling us no end until we set up a dmp through cccs, they then had the cheek to write to me and say that the offer was too low and were passing it over (dont know where) and should have already received a letter from them. That was last October - we havent paid our dmp since last December and not heard a word from them or anyone else about it since!!!! Now being br they cant do much about it lol!!!
We have HSBC hasseling us, a letter a day at the minute, but hopefully once they get communication from OR then that will change!!BSC # 308I should really rename myself mummytothree!!! Child no3 born 14/09/10ED 12/01/110 -
Got my DRO a few days ago and had these jokers on the phone today, im refusing to confirm my DOB and told the chap he can get in contact with the insolvency service if he wanted more info. He kept saying I could be anyone and/or lying and its not their job to find out stuff that that. *rolleyes*
How long should I give them / how long will it take the OR to get in contact, before complaining about harassment?
That post from Magpiecottage is great :T Mercers have been ignoring my request to not phone early in the morning as im on late shifts for months now.0 -
