What benefits does your partner get at the moment, is it a joint claim?

  • you could claim State Maternity Allowance?

I doubt you'll get IS but i think you could poss make a joint claim for JSA.

i think SMA is your best bet :)

Op will need to check if she has worked for 26 weeks up to her test period. As not worked past 9months I doubt she has, therefor no MA

You have to work to get MA.

  • Looks like the only option is JSA then. Of course theres always HB/CTB but if they have been out of work for this long i assume OP must have claimed this already!

Once you come within 11 weeks of the sunday in the week in which the baby is due you satisfy a condition of entitlement to income support.

To get Income Support, you must be a person who does not have to look for work in order to get benefit. This means you can claim Income Support instead of Jobseeker’s Allowance which would require you to sign on and seek work. You may be able to choose between claiming Income Support and Jobseeker’s Allowance if you would rather meet the requirements of seeking a job.
For more information about Jobseeker’s Allowance, see Benefits for people looking for work.
You don’t have to be available for work if you are:
    • a lone parent bringing up a child under 10 on your own
    • getting Carer’s Allowance
    • looking after your partner, who is temporarily ill
    • looking after a child under 20 for whom you are responsible and who is temporarily ill
    • incapable of work because you’re pregnant. Some pregnant women might be able to claim Employment and Support Allowance (ESA) instead.
