would she qualifyfor incapacity benifit

hi there , my partner has DLA high rate . would she qualify for incapacity benifit also . i work full time and earn about £20k a year . she gets stamps paid but is in constant pain with her hip had injections for it but didnt work the only real pain relief is morphine based pain killers which she doesnt want to take, if she failed th medical for incapacity would they take her car and dla away also we have been living like this since 2004. all replies welcome.

    no they wouldnt take her car thats dla related and has nothing to do with i/b, if i.b are paying her stamps i.e prension credit then she cannot get i/b paid as well im afraid as i found out myself.

    She is only being paid credits because she would not receive income based IB due to your salary. I assume she does not receive contributions based IB because she has not paid the required NI.

    That is correct, but she does get DLA and you are a couple.

    You earn over the threshold on your salary for her to be entitled to income based benefit.
    My husband works full time and earns over the threshold but because I have worked full-time I am entitled to contribution based benefit. If I had not worked full-time for the required qualifying years I would have just had my stamp paid.

    off topic but you partner needs to seek an effective pain regime from a pain managment specialist, opiates have a bad press that they dont deserve today, many people use opiate based medicines on a daily basis to give ourselves the best quality of life that we can have, I will always be in pain but I can lower the pain to acceptable limits most days.

    hi su nnyone dont know what opiates is ,she attends the pain clinic and so far no joy i persuaded he to get the injections in her hip she said never again and it didnt work she has a n appointment in march. phoned helpline today and posters are right because i work full time she gets nothing same as because she hasnt worked for 3 years .

    opiates are morphine based drugs, well nowadays its often synthetic opiates and they are nothing to be scared of, its not going to turn her into a zombie or any of the other things people worry about and nor is morphine the strongest pain killer which is also what many people assume as well.

    She has probably already been on opiates, you can buy then over the counter in the weakest forms and commonly prescribed painkillers like Tramadol, codiene, Co Drydamol and Dyhydracodine etc. are all opiates.

    The best thing she can do is reasearch these meds and have an idea of what shes intrested in before her next pain clinic appointment, most people find a cocktail of diffrent meds and therapies are the best solution but we are all diffrent.

    Sorry boards guides for going off topic but I hope you can see why I brought it up.
