    Exactly. A lot of companies, especially smaller ones, very rarely are aware of the exact procedures to be taken over disciplinary action because either:

    i) Their not aware there is a legal procedure to follow and think/assume they can go by their own rules (especially if they own the company).

    and/or

    ii) They've never had to discipline anyone before.

    and/or

    iii) They underestimate the member of staff in question that they will actually do their research beforehand.

    OP your boss sounds incredibly arrogant to me and tends to do things his way and stuff the consequences. But unfortunately for him when it comes to Employment Law he's just a complete ar*e and either thinks he's above the law or he hasn't bothered to check the procedure he should follow.

    I would definitely go in on Monday morning, tell them you won't be attending their arranged hearing and hand them over a letter informing them of this including extracts/quotes from Employment Law in regards to the illegal disciplinary hearing they arranged, then request that they inform you of the new date.
