Unfair Christmas Eve or New Years Eve working

  • Christmas eve and new years eve are not Bank Holidays, so the student may have to do something he was unable to do at the age of 16, WORK

The OP is also completely oblivious to the fact that there is no automatic right to bank holidays off in employment law judging by the fact they asked for them to be declared half day bank holidays.

Since the start of this year a company must give employees a minimum of 28 days holiday (assuming they work full time) including bank holidays. Also in most people's contracts it will say something like you are entitled to bank holidays off but if you're needed to work bank holidays you will be given ample notice and alternative time off or extra pay.

The person who has started the thread is a student so obviously young and doesn't know the ways of the business world.

You shouldn't make assumptions on people like that. I've been in full time employment since a few months after signing up this forum but can't change my username. If someone had the username Ian1979 I wouldn't assume they were born in 1979, it might have been the year something special happened, like they got married.

There's no point moaning about it. If you get off early great, if not you're being paid to do your job.

At my work if you book either day as leave you have to have the whole day as leave regardless if the rest of us are told to leave early. Nothing unfair in that at all.

So on that basis if you work 8-6 Mon-Thurs and 9-1 on Fri and your employer says you use a full day of holiday entitlement whether you want a Monday or Friday off then you can't complain?!

It's amazing how judgemental some people are, I'm 26 BTW and have 6 years full NI contributions. Maybe I'll assume Freddie_Snowbits will melt within the next couple of weeks as he's obviously made of snow and snow melts.

The 28 days bit is right, but not the bank holiday bit. In fact the employer can make you use 8 days of the 28 to cover bank holidays.

Have you read "most people's contracts" then?

  • Businesses are there to make money, without this basic premise, there would be no businesses. No businesses no work... we could all have christmas eve and new years eve off... whilst sitting in a snow covered field hungry and homeless. Compared to what your grandparents used to work we have it easy. Be thankful for paid holidays, paid sick leave, bank holidays and all the other paid benefits. If you are lucky enough to get to go home early, make sure you let your boss know that you appreciate it.

  • As a chef I worked Christmas eve/day and new years eve/day I'm sure most people are aware of the sacrifices that your chosen career brings, doing an online petition isn't really going to make people feel any form of empathy towards you.

No, IF you worked days of uneven length like that then your holiday entitlement would be calculated on the basis of hours, not days. Therefore you should be required to take the number of hours applicable for that day.
