Help please with cancelling orange mobile contract

I would like to cancel my orange 36 month contract, it started on the 1st of october last year. How can I do this without incurring a penalty? Any help would be very much appreciated. Thankyou.

Legally a third party can't sign you up for any kind of contract, please explain more ??0

Ahh, I see I misread the second post (due to the over uses of !!!!)...
After more than 3 months you've almost no chance of claiming a mis-sell, unless you've called and logged it with the network in the first few weeks.0 -
hi,
i recently signed up with orange for a 24month iphone contract through phones4u
and tried to make a payment which was then declined by orange as i am only 17
and should not of been given the contract in the first place i tried twice to make a payment
and was unsuccsessfull on both occations,
today (08,01,2010) i recived a letter saying i have to pay £138 charges to orange or legal
action would take place. I then rang orange and was told i should not of recived the contract
because of my age and i have to pay the charges and send the phone back.
i have spent around £50 in apps for the iphone and was told basicly tough,
please can you advise me what to do as i would like to keep the phone,

You can not legally have a contract at 17. I'd love to know what ID you used to get signed up?
You can either do what they ask and send the phone back, or (maybe) if you can find someone else to take over the contract and you could pay them. They would need to able to pass the credit check, but Orange do allow acc transfers. You would need to check with them that, that's an option.0 -

In this case they can. The customer should never have been given a contract and can not legally have one due to his age, therefore no parts of the T&C's apply.0 -
i have been on the phone to orange and the contract has now bees scrapped but they require me to send the phone back in a jiffy bag
however i exsplaind that i hasd sent over £50 in apps
they where kind of nasty back and basicly said you will be sending the phone back
i applied for a contract at my local phones4u store in shouth shields gave my d.o.b and debit card deatails which can both be checked for proof of age at no time i was told i was too young and i got the the iphone within 10 mins of appliyng
when the bag comes im simply going to send the sim card back but no phone
hope it go's well
oh and btw orange have asked for a copy of my birth cert
should i send this in???

It won't go well. If you don't return the phone you'll be chased for the cost of the phone, you can't have a contract but you can have it PAYG, and whilst at 18 you can't legally hold a credit contract in your name, you could be charged with obtaining goods by fraudulantly. If they can't get you they'll go for your parents / guardian for the costs.
You may have a case against the shop who sold it to you but Orange are in the right.
The fact you spend the money on the apps is unfortunatly your fault, legally you can't have a contract and so you either need to return it or try and get it moved to PAYG and pay the extra cost that a iphone on PAYG is over a contract one. If it's like the ipod you can de-authorise that phone, and when you get a new one move it to them.
It's probably not good for you to have a black mark on your credit file before you get to eigthteen.

If they've ask for it send a copy, its to prove you're under 18. Some people try it on, get a contract and then claim to be under age when they change their mind or run up a bill they can't pay. Once they have sight of that they'll cancel the contract....0
