I don't believe this would be considered unfair condition it protects shops from people who they belive are stealing from them and returning for refund.

Doesn't requiring a receipt do that?

I know that a lot of shops will offer an exchange or store credit without a receipt, but unlike their usual no-quibble with-receipt refund policy, it is rarely actually advertised, hence not part of the actual contract and hence goodwill, subject to any condition they feel like.

    Absolutely right.

But it can be expensive... ask all those timeshare buyers of old.

I think this is unfair, sometimes when you are shopping you see something you think you really love and you get it, impulse buy or whatever and then when you get home you realise you dont like it as much

Its not a crime to change your mind!

Well no. But a shop isn't legally required to offer you a refund because you changed your mind.

Of course if they offer additional rights for their shoppers, that's a separate issue, but I'm talking about what the legally required minimum that they have to do.

It always makes me wonder the people who say you have "no rights" in this situation.

Surely if when the OP bought the shoes from JD Sports they said that he could refund them if he didn't want them (and didn't wear them), then surely that forms part of the contract and hence he DOES have that right?

I think so to, though I've been wrong before. Of course even assuming we're correct in this assumption, the question now is what exactly does their T&Cs say? Does it say "refund, no questions asked" (beyond what we've mentioned here I mean) or is there a carefully set out list of qualifications and exceptions to that claim which the manager is carefully sheltered by in this case?

Any clause that says it's subject to manager's decision or similar would probably be an unfair contract term, and hence invalid.

I think that might depend on the reason the manager used.

Does the retailer in question actually say that refunds will be given for a simple change of mind?

At the end of the day JD Sports will come worse off because of refusing the refund. Word of mouth is a powerful thing, so is a high traffic website such as this.

This behaviour shows a disregard for their customers. Perhaps the manager has no discretion and is just doing what he's been told to do but that does not excuse the ignorance and substandard customer service.

People return non-faulty goods all the time. There are many valid reasons as to why the OP might want a refund, there may be personal reasons which the OP does not want to disclose such as an unforeseen financial problem occuring after the goods were purchased.

But the bottom line is the retailer does not have to refund.
