yea, if you have an apple store near you, go there. they're fantastique when it comes to repairing/replacing their products.
i had a problem with my iphone, went in and literally less than 5 minutes i waltzed out with a replacement.
make an appointment for their genius bar at apple.com/ukhelpful tips

How long have you had the ipod touch? Everybody loves to instantly recommend the SOGA route, but if your warranty is with Apple, then it's worth contacting apple and reporting the fault with them, because they deal with things very quickly. A friend's ipod which he bought elsewhere went wrong, he walked into the apple shop with it, and left with a replacement in about 5 minutes.
Issuing a stern letter to HMV quoting your legal rights, waiting for a reply and so on will not only take LONGER, but could end up costing your more money than just getting the authorisation code from apple, or taking it to your nearest apple store.
If the Op wants a refund (assuming there is a true fault) then they can only get this from HMV. Beside i fail to see where the OP will incur any costs from this.Back by no demand whatsoever.0 -

To be honest the (default) Youtube video app on the Touch and iPhones are crap. I regularly get this issue and know many others that do too. it's just not as slick as on a PC.
I don't think that its the actual machine that are the problem I think it's something to do with the conversion of the file, as the iPods don't support flash.My farts hospitalize small children0 -
Bought this item on sunday just gone. I bought this from an HMV shop and therefore HMV should be refunding me not me going to apple for help etc. There is no apple store near me anyway.0

Returned to HMV and spoke to a different person after quoting SOGA - no problems and got our refund. A result !!!0 -

Not true, read the parts on rejecting goods within a reasonable time. This allows for a full refund. What you are mentioning applies AFTER this "reasonable" period has elapsed and the goods are deemed to be accepted.
As you can see, following my advice, the op got a refund quite easily. HMV know SOGA and know that by law, they mist issue a full refund, no ifs or buts really considering the time elapsed.Back by no demand whatsoever.0 -

I then explained what I had meant, should the OP have had the problem AFTER a reasonable length of time.0
