Pulled on way home with new car.

Im wondering if anyone could offer some advice please. Please bear with me this is a long one.

We took DH's friend to Manchester from Leeds to buy a car yesterday, the person he bought it from said he was leaving the insurance on the car till the end of the week and as DH's friend already had insurance on another car and was covered to drive other cars 3rd party only we all thought he would be ok getting home, on the way home he was pulled over by the police.

The policeman said he had pulled him over as the car he was driving was registered in Manchester, so he asked for license, which he showed him, then the policeman asked for insurance, he explained to the police about the insurance and said that he didnt have his insurance documents with him as he has lost them during a recent housemove, the policeman rung the insurance company and confirmed that he was insured to drive other cars 3rd party and the policeman said that it was fine but he will still have to produce.

So he got home, rung the insurance company up himself to confirm again and request another cover note to produce to the police, they said it would take 10 days to go through but he could ask them to ring the insurance company up with his policy number. He went today with his wifes cover note (as she is a named driver on his policy) showing the policy number, they refused to accept it and also refused to ring the insurance company.

So he has once again rung the insurance company up, they have sent him a cover note out Special Delivery, but after speaking to them the bloke on the phone said that he wasnt actually covered on the car whether the previous owner was keeping the insurance on the car or not because by signing the V5 he is now the registered keeper, now he is worried the police wont accept his insurance and also state this and that he will get 6 points and lose his license as he already has 6 points.

Surely the police wont pull up on this because as the Policeman said the car was still registered in Manchester when he pulled him and will be until the DVLA receive the V5 from the owner.

Should he be ok or is he likely to receive the points?

    When the V5 was signed it was also dated.

    I'm surprised the PC didn't pick upon this straight away, I'm also surprised someone would be pulled over for being out of town!!

    Once you buy the car how can the previous owners insurance be used?
    They no longer have an insurable interest in the car.

    Your mate should have bought insurance, and is now looking at 6 points, £200 fine and an IN10 :(

    Once he'd bought the car he owned it so had no cover under 3rd party as he owned the vehicle REGARDLESS OF WHETHER THE PREVIOUS OWNER HAD IT INSURED. What thought process went through your mind which made you think it was OK to drive a vehicle on "3rd party not belonging or owned by the policyholder" when it clearly states it didn't cover something he owned which he did the minute the cash was handed over and the deal done?

    So your husband has been driving it around uninsured since yesterday. Has he got the insurance swapped over onto it now or is he still driving it around uninsured?

    Your husband won't be able to prove he was insured for a vehicle he owned at the time he was stopped because he didn't actually have a policy in force on it.

    You might be lucky but I suspect you won't be. 6 points for no insurance guarantees some hefty renewal premiums for the next 3 years.

    Just think, if DH phoned the insurance company when he'd bought it and transferred the policy over there and then, he'd now not be facing 6 points, a fine and horrendous insurance for the next few years.

    Actually if you read the post properly you will find its DH's friend NOT DH, so I dont appreciate your attitude towards me, if it had been me or DH we would have had the insurance swapped straight away but it wasnt us, was it.

    I came on here for some advice for a friend not a lecture.

    He wasnt insured, it was his responsibility to ensure he was. He will be charged and should plead guilty early with the mitigation to minimise the fine. He will get 6 points.

    I dont have any sympathy tbh as he should have ensured this all before buying the car.

    It was her DH's friend who got pulled and I can see why they may have thought it would have worked but unfortunately that's just isn't how it works. Although surprised that between the three of you you didn't realise that it wouldn't work!
    Oh well, live and learn. TBH it's extremely lucky that he will just get the points on a fine as he could of had an accident without insurance. Then HE would have been held personally responsible for all costs to the third party AND he would have got the points and fine too!

    Why didn't he just call the insurance company and change the car there and then? It gets switched immediately.

    Tbh with you im not clued up on this sort of thing as I dont drive at all, I think its just one of those things that seems really obvious now but at the time it wasnt even realised.

    The only problem is with the 6 points he will get and the 6 he already has, chances are he wont have a job either.

    In which case he should definately have swapped his insurance! With 6 points and a job that seemingly relies on him having a licence it seems ridiculous that he would do this.
    TBH, I wouldn't have even come on with his problem as it's not yours!

    I have to agree, once the log book has your new details on it, the old keepers insurence is void because his circumstances have changed, i.e no longer owns the vehicle.

    you can always buy special one-day or drive home insurence which exists solely for this purpose. the police are doing their job.

    current savings: 20,500 (target hit yippee!)
    Debts: 8000 (student loan so doesnt count)

    new target savings by Feb 2010: 30,000

    I don't think computershack was giving anyone a " lecture " just telling you it as it is, your friend must be stupid if he/she thought for one moment that they were insured under the circumstances.

    Why would the Police pull a car over just because of where it is registered that does not add up, if they did that as routine they would be pulling millions of cars over every day.:confused:
