not getting deposit back

    nothing yet because they havent even wrote to us giving a list of what they are holding the deposit for!

    What i mean is, they spoke to us on phone and said the conservatory door was broken, and they couldnt get into the back garden.

    Since then the pictures have now come onto the internet, which have being taken in the last week since we left.

    They have now suddenly being able to get into the back garden, so the door is working fine.

    But yes no inventory anyway!

    yes they got til thursday pm. its with tds, sending LA another letter tomoz reminding them
  • With regard to the carpets - can you clarify if there was a requirement in the tenancy agreement for the carpets to be cleaned or professionally cleaned at the end of your tenancy? If so, when you mentioned cleaning the carpets during your tenancy was it at the end?

    We had cream carpets in the house we rented and they looked tatty at the doorways but a clean (just with our own Bissell) made them look much better. If you were supposed to clean them at the end of your tenancy and didn't then you have a problem in that regard.

    am now fuming lol!:mad:

    Just had a reply back from LA, with an email from LL's dad attached.

    LL's dad has sent:
    Perhaps you could advise when quotation for carpet cleaning and conservatory o/s door lock repair is to hand. The cost of this and a sum to cover the items below should be paid for from the bond.


    List of items needing attention following tenants departure 29-12-2009

    All Ground floor carpets need professionally cleaning.(photo available)
    External conservatory door lock broken. (unable to open door)
    Double gate door lock broken (unable to open)
    Vacuum cleaner....hose missing.
    Breakfast bar fixing loose.........done
    Towel rail fixing loose.....done
    Filthy cooker needs cleaning ......done . (photo Available)
    Fridge & Freezer defrosted ...was left on !!??

    Already mentioned the carpets - they were cleaned during tenancy and this didnt remove marks which were already there. (as above poster said - nothing saying carpets must be cleaned - just that the house is cleaned to a proffessional standard). When we moved in it needed hoovering properly because there were dead insects round the side of the carpets!

    Already mentioned conservatory door - nothing wrong with it as they have used it since!

    Gate lock - another lie, we were using it while the LA's inspector was there!

    Vacuum cleaner was under stairs, and has remained there ever since because it was an old piece of rubbish, weve not touched it!

    Breakfast Bar has always being loose because the walls are plaster walls

    Towel rail has always being loose, maybe for same reason (tiled over so not sure)

    Cooker was filthy when we moved in and needed scrubbing before we used it. It was again scrubbed before we left and was cleaner than we found it, and was as clean as it could have being!

    Not sure what there talking about ref fridge freezer! We asked LA inspector what to do, and he said leave it on so it doesnt defrost all over the floor.

    I am so mad!

    So received the below from the LA attached to the above email:
    The landlord as now had quotes for the lock and carpets , and as agreed that the bond money should be split in half £312.50 each to landlord and tenant , the email below states other jobs found, if this is not satisfactory please let me know so I can advice the tenant dispute service and send the full bond monies to them until the case as been looked into by an independent adjudicator, this procedure can take time to resolve as they require all notes and photos they will then decide who they return the bond to and may also agree a half split.

    Having had the carpets cleaned while we were there, it cost £40 to clean a room. so where £312 has come from i dont know. ive had no copies of quotes etc. no photos, which they are saying are available!

    I just cant believe some people!!!!
    We look after the house for nearly two years and as the LA said "its always clean and in pristine condition". We put up with no repairs being done etc and this is how they treat you.

    What shall i respond to this with?

    need to send a reply today if possible, so i can still stick to deadline of thursday for referring to TDS.

    I believe i need to try my best to resolve with LA before i can refer my case?

    Until you have received proper written communication regarding the amount that the landlord hopes to withhold from your damage deposit, I would completely ignore that unprofessional e-mail from the landlord's dad (what exactly does he have to do with it??). Deal with the landlord and perhaps the letting agent, simply ask for your full deposit returning by return of post.

    Incidentally what do the letting agents mean "split in half as agreed"? Ignore the veiled threats of the TDS being a slow process and you might still lose, IIRC it's 40 days and they appear to have no dual signed inventory. :rolleyes: Keep a copy of that e-mail, the TDS might be interested that the agents are trying to bully innocent tenants out of exercising their right to invoke the dispute process.

    the LA seems to have a faulty "h" key and means the LL's dad has agreed half the deposit would cover it!!

    So will it be best for me to send them a letter in post, recorded delivery?

    Something along lines of, i have received the email but am still awaiting the signed inventory as stated in original email? Failure to provide either inventory or deposit in full by xx date will result in referring it to the dispute service?

    You have muddied the waters here by dealing with the letting agent via e-mail instead of the landlord via recorded delivery, so I am at a bit of a loss as to know exactly what I'd do in your shoes. My gut reaction is that you have had NO formal communication with the one person who is responsible for returning your deposit, and this needs to be rectified. Whatever arrangements are being made between two people you have NO professional relationship with (letting agent/ landlord's father) to repair a property you no longer occupy are really not of interest to you! Just write to the landlord and ask for your deposit returning or a full response to your earlier e-mail.
