Ebay return help please....

I think Im in the right here, but Id just like conformation really, and advice as to what to do if she doesnt do it....


I bought a pair of shoes from a seller, paid by ppaypal, all went fine, and the package appeared a few days later. Opened the package, and it was the wrong shoes - she'd accidentally sent me a pair the same size, but completely different make (Irregular Choice heels - which is what i thought I was buying,but I misread the advert for the ones I ended up with!)

I mailed her to thank her for the speedy delivery etc, but they were the wrong shoes, and what did she want me to do - I was assuming that there was someone else around who was just as confused as I was, and I know she says she doesnt accept returns,but I assume in this situation (her sendiing the wrong ones out!) she would, but i was quite happy to keep them if it was all too much hassle for her to sort - to which she asked me to return the pair I had and she would get in touch with the purchaser of the ones Id been sent....

(with me so far??!!)

My answer was that I was more than happy to return them, as soon as the postage money was put into my paypal account.

I really dont think I should pay the postage,it wasnt my mistake !! I havent heard from either her, or paypal to say that its been done yet,so the shoes are still with me - but am I being petty?? Its only £3 or so - but I dont think thats the point??

What concerns me more is that if she doesnt give me the postage money back - am I doing anything wrong by keeping hold of them till she does?

    Do you like the shoes as much as the pair you thought you were getting, and are they worth the same? If so, I would keep them, as returning them would be at your expense, and you can't guarantee she'd refund the postage.

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    You are quite within your rights from what you have said - including a refund of your postal costs (if it was their mistake, which it obviously was). Petty..............well as a seller who sells a lot on ebay I would say probably yes. But at the end of the day that is only my view. If it was £10 p&p I probably would have a different opinion. Either way you have done nothing wrong so I understand you not wanting to be out of pocket!

    Thankyou you two - youve both pretty much said what I thought. I'll keep hold of them then.

    I thought the pair I was bidding on was a pair of Irregular Choice shoes - but the ones I bid on was " Irregular size 7 choice shoes" or something like that - hence it showed up in my search, and I didnt read the title properly.

    My main "gripe" isnt that shes sent the wrong shoes, I sell on ebay quite a bit too,accidents happen!! - and as Ive said, I'll happily post these ones (which ARE IC shoes, and if nothing else Ive been able to try them on and know that 7 would be too big, so its helped me out a bit!) back when she gives me the money for postage....

    but if she doesnt, and I post these ones back (for whatever reason - Im not for a minute calling her a cheat !!) that makes the £4.99 I paid her for postage £7.50ish (the label on the package was for £2.29 postage!) and in turn makes the shoes £3 more than I was willing to pay for them....

    think I shall hang on for a week or so and see if she refunds me money for postage.... (and I will mail her and tell her if it helps wit how much to return to me - it says £2.29 on the post office label... ;) )

    Hang on, do you mean you thought you had bid on 'A' pair but you had infact bid on 'B' and the seller sent you 'B'..so you bid on the wrong shoes but the seller sent the right ones that you had bid on and won?
    She has the loaded handbag of someone who camps out and seldom goes home, or who imagines life must be full of emergencies..

    lol - i wanted a pair of Irregular Choice (for anyone normal here - thats a make!) shoes. I did a search - and bid on what I thought was a pair of IC shoes - but when I went back to pay for my won shoes - I saw that the title was "Irregular size 7 choice shoes", so these werent irregular choice shoes, Id mis-read the title of the ad. I apid up though - these might well be ok for bumming around the house and stuff, and it was my !!!! up after all.

    When my parcel arrived - what it contained WAS a pair of IC shoes (black ones with a ladybird on) NOT the pair I was bidding on (which arent black,and arent high heels). She has basically sent me and another lady the wrong shoes - and appears to be expecting me to pay extra to help sort it out for her....

    So, to clarify:

    you bid on the wrong item (your error as you've admitted) but the seller didn't send the item you'd won, they sent some thing different.

    Is that accurate?

    If so, you are in the right and the seller is in the wrong.

    This happened to me a while ago.
    An Ebay seller had obviously had 2 similar items for auction and when they ended, he sent me the item that the winner of the other auction should have got, and MY item went to the other person.
    My guess is that he'd packaged them both up and just put the wrong address on both parcels.

    As soon as I opened the package, I emailed the seller and asked what he wanted to do.
    He asked me (nicely) if I'd mind posting it to the other person and he'd contact them to request they do the same.

    I paid the additional postage and he then sent me a cheque to cover it.

    OK, she doesn't accept RETURNS - but this isn't a case of you deciding that you don't like an item that you've bid on and won.
    It's HER mistake.

    Thankyou very very much, will be interesting to see how long it takes her to contact me again - I mailed her again a week ago,and she still hasnt replied,so.... :confused:

    I'd give her a few more days and then try again.

    I'd also check out ebay to see what your rights are - timescales for raising a dispute etc just in case your seller is being difficult.

    Let us know what happens.

    emailed again yesterday - still not heard a dickeybird. (of course,she might be away or something,but Id have thought shed have mentioned that when i first said about it ??) Ive even told her that the postage is £3 if that helps !!!
