The point is, this is the January sales. Sofas, suites, etc DO sell for ridiculously low prices at this time of year and therefore people are right to go for a bargain if they are lucky enough to see one. I have a friend who was lucky enough (a number of years ago) to get a suite for £10 in the January sales.
People who placed orders could not have known that product codes posted on companies websites relate to anything other than the photo of the goods being advertised (especially when searching the product code brings up exactly what you are looking at, ie a sofa). I would suspect that most people who spot a bargain sofa don't take time to read what it's made of as the the euphoria of finding such a bargain in stock will no doubt take over. Edit...even if they did see the incorrect 'made of' quote, how are they to know which part of the offer, if any, is incorrect - the picture, the description, the price?
What happens from here on in is between those who chose to order these items, and M&S.
Laws/regulations are in place to protect both the consumer AND the retailer. Sometimes consumers win....sometimes retailers. Depends on who was in the right .....that's how the final decision will be made. It doesn't matter what you, I, (or Fred Bloggs) personally thinks.....legal arguments will most likely decide the final outcome of something like this.
Anyone who doesn't read the description is stupid beyond belief...I'm so sure people order sofas without first even glancing at dimensions,whether the cushion covers are removable and machine washable or if it's specialist clean only:rolleyes:
EVERYONE knew darn well that it wasn't meant to be a sofa,those who thought it was had it pointed out before they ordered.They then proceeded to order 'for a laugh'.If anyone is as greedy and selfish (and certainly not trying to save money-if you are trying to save money you don't just buy everything and anything because it's reduced or has a glitch)to try and take action I would love to move over to their legal team for a period to sort it!

I made it clear I wasn't coming down on the side of the retailer or the consumer - just pointing out that it is January and just maybe it could have been a genuine offer as this is the one time of year this is likely to occur (apart from the infamous water butt mid year). Likely it wasn't a genuine offer, likely it was a mistake. I have no worries either way, but do understand why some people went for this.
I also raised the point that this country has regulations in place to protect both consumer and retailer and, if it comes to it, those laws/regulations will decide what the outcome will be.

I beg to disagree....maybe in some cases weird descriptions accompanied the images, but a lot of the items had no description just images of the item on offer.
I'm not arguing the rights or wrongs on this, just pointing out that it is January, companies do offer ridiculously low priced bargains at this time of year and therefore it is not totally unreasonable to believe this may have been a genuine offer.
All the sofas had a description of some sort.All of them also said available for store pick up.

Oh boy, some jealous folk spending time getting really riled up over this. How unfortunate for them.
I figure that M & S are on a sticky wicket with those customers who have had a confirmation email stating sofa/price/delivery. Time will tell, but in the meantime lets all be friends. Lets all be nice - this is mse. Some will win and some will lose. Whats the big deal. I think this will be ongoing amusement for a selection of us who placed an order and a talking point for a long, long time. :j0 -

Not jealous at all, people are buying them who did not even need them and that had nowhere to put them. And then to sue because you did not get it? I am just sick and tired of people on here going on about suing people for something they did not get because of human or computer error. It is just getting more than embarrasing beyond belief. We are turning into a nation of vultures.
It is just embarrasing. I used to love MSE for what is USED to be, it was for finding glitches and sale items and being the first to get in and get them, or to find clearance items that no-one else wanted but you might. It used ot be a community. These days it is full of angry 'smileys' and people 'furious' because they did not get their sofas or (more recently) sweets, because of a website mix up and everyone wants to sue someone. People buy things they do not even want knowing it is a website mistake with intention of suing because you missed out on a 'bargain' or because a retailer made a mistake??
So someone went into work that day and made a mistake that is all. It is life, sometimes it happens. Everyone has been into work and made a mistake - I know I have.
The thing is that it could also mean that someone or people might lose their job/s over it if a company is forced to pay out £1000's in compensation because of a silly and obvious mistake. If that makes ANYONE feel good about themselves then good for you, it is certainly nothing to feel jealous about I can assure you - ashamed, yes, jealous no.
And to think it is OK because it is 'a big company'? Did anyone know that even John Lewis has made people redundant recently? JL has always been a big employer in this town but not any more. Everyone is in watching the pennies, never assume that something makes no difference. It is all about values at the end of the day. I like to feel I still have some. And that is why it makes me embarrassed to feel that you are so desperate for something, something that is deemed a luxury, to sue someone over.
As I say, MSE USED to be a great place to be, these days it is just full of people looking for someone to sue for not getting 'a bargain' or something they did not actually need but had the money to 'buy'. I am sure Martin Lewis must be very proud.0 -
