Sorry to hear work are giving you such a hard time. Is it even legal for them to say such things?

Are there any local supermarket/pub/shop jobs near you? Might be an idea to consider doing something temporary, to keep the money coming in, so you can save yourself from going back to the other place and have an income whilst you find a more suitable job.

    xx

Thanks euro, I think the 28 days absence thing is due to my being on a fixed term contract, so as far as I know they can do what they like.

I would jump at the chance of any other job to be honest, I worked in retail for 3 years before starting this job and kind of wish I'd stayed there! I'm waiting on a reference from current employer to do some admin bank work but don't know if that will be forthcoming now.
Sashy... what do you want to do? Is it feasible for you to quit? Sometimes health is more important than money. I'm sending you lots of :grouphug: and positive thoughts! (I only have a few positive thoughts but I'll share with you :) ) xxx

The legal side of things is worth a thought but if it's a temporary contract I'm not sure how it all works... besides if you hate it, it's probably not worth putting yourself through the hassle of suing them or kicking up a fuss.

I would love to quit but we really can't afford it and OH would lose the rag with me if I resigned. :( Thanks for sharing your few positive thoughts.

I believe they can sack for being off sick as you are unable to fulfill your contract. However, if the problem is linked to a recognised disability then they could have a problem as it may fall within the remit of the Disability Discrimination Act. Of course, having a witness (or better still getting it in writing) that they will dismiss if staying off sick could involve returning to work too soon and having an errrrrrmmmmmm accident due to being ill (if you get my drift).
Bear in mind that if you've been somewhere under a year you can't do to much about dismissal if you can't prove discrimination.
If you want to know more, don't take my word as gospel. Legislation changes and I haven't had any need to keep up to date.
I hope the boss gets a dose of the clap.

I had the same problem when I had my 4th back operation and was off work for nearly 7 months. The doctor actually rang my work and told them that they were wrong to harass me and if they were not happy with his sick notes then he wanted someone from my works Occ Health to come to his surgery and they could examine me together. He also told them that they were on dodgy ground as I could put in a harassment claim if they continued. Strangely they became quite amicable after that.

Now that is what I call a doctor.
