If anyone is feeling a bit sore at losing out on this deal, imagine how this guy must feel
Ladbrokes, the bookmaker, has refused to pay out an accumulator bet worth £7.1 million to a man who wagered snow would fall on Christmas Day because it was accepted by mistake.
Officials at Ladbrokes’ head office told him that he was owed just a measly £31.78
Cliff Bryant, 52, from Southampton, placed two £5 accumulators on snow falling across 24 towns and cities in the North and Midlands on December 25.
But staff at the bookmakers accepted the gamble by mistake as the company rules state such a wager can only be a single bet.
The graphic designer is now seeking legal advice over the error and said he was ''gutted'' at the decision.
''This is a genuine mistake and if I make a mistake in my work like that it costs me dearly and I think the offer should be a lot more generous than they have made,'' he said.
''They are one of the leading bookmakers in the country and I think they ought to do their homework a bit better in future.''
He urged the company to make its rules clearer.
A spokesman for Ladbrokes said company rules state that ''snow at Christmas'' bets must be singles only, rather than accumulators.
''We have apologised to the customer for any confusion and for mistakenly accepting an accumulator bet when our own rules state that only single bets are available on a market of this nature,'' he explained.
''We are happy to void the bets and to pay the customer his winnings on the relevant singles.''
Under the Gambling Act 2005 a bet is now an enforceable contract and Section 334 repealed the old provisions preventing enforcement.
However, Section 335 of the Act, relating to the enforceability of gambling contracts, states ''...gambling contracts may be void on the same basis as any other contract (for example, on the basis of lack of intention, mistake or illegality)''.
His argument has 'legs' however, there are a number of judicial precedents where the courts do not uphold a gambling contract, but as stated above, the Gambling Act has made inroads into that. It depends how much Mr Bryant wants his 7.1 million
He is going to need reasonably deep pockets to get the advice he requires to be in with a chance of it. Could be another wager for him....:D0 -
thanks alias jo, and others, i rang the number advised on here, they put me through to their manager, my order on argos said *delivery between 7am - 6pm 31st december, but now it's saying *we're sorry but we can't provide an online update for this order, blah blah please ring... and then the number i rang today
any advice anyone? this is for my dd's birthday on the 18th so am hoping someone can advise what to do now...

Did you print it up at the time or do a screen grab? I presume you have rang HDNL, what did they say, did they give you an reference number, they can do it if you give them your postcode? Did you get a reference number starting AD********** from Argos?0

I have two orders and two numbers but Argos will only let me have one machine. Just going to pick it up now. Is it worth trying again for another one do you think? Ordered one for each child using their christmas money0

rosatosa, no i didn't...i'm technically inept and have no clue how to do things like that...
i have rung hdnl and they say they have no record of any delivery for my AD number or postcode etc...
like i said before i ordered it and paid on the 30th dec. delivery was due 31st dec between 7am and 1pm and then they cancelled.
cheshire caper seems to be intimating that it is irrelevant whether my dsi was actually dispatched, however argos are refusing to budge...
wouldn't normally let things like this bother me but it is for dd's birthday this month, so any advice on how to proceed further?0 -

Now Im completely lost and very peed off. I phoned management just now cuz the black one I initially ordered looks like its never gonna be back in-stock in my area, its been out of stock since before Xmas. I spoke to a lady asking her if I could change my choice of colour and she told me yeh but even so id still be getting charged the full amount =/ and the same once the black ones in-stock! I told her straight the woman i spoke to lastweek from her department said the mis-price would be honoured and then shes like well none of them have been honoured!! !!!!!!!! I told her those that were despatched before being recalled are being honoured but she still played dumb. Anyway she said shes gonna listen to the call recordings of the calls I had with the other lady then get back to me later today. This is bulls**t i thought management would all be clued in by now.0

No luck for my order....
Just phoned Argos and said what trading standards have said about the contract being formed. After waiting about 5mins for a manager she wouldn't have it. She said that the contract was not formed and according to the Argos T&C's they have the right to cancel the order. I explained that I haven't accepted any T&C's nor was read any but she still wouldn't have it.
I phoned the general enquiries line but forgot to be asked to be put through to customer relations as someone suggested. Could it be that I just didn't get hold of the right person?
