    Their T&Cs state that the contract is only made once the goods have been dispatched, so I think you're going to be struggling to be honest. Somene has said on here theyve managed to get one without proof of dispatch, but I think theyve just been lucky.

    I dont know, legally, if theyre right or not.

    Just called customer services. Great news, I have also been informed mine will also be honoured as was one of the recalled orders. I do need to wait for "someone" to call and confirm date etc was told I will get the call by Monday morning. Yeah....

    See my comments previously. post #705. Terms and conditions have *no* bearing upon when a contract is established. English law defines when a contract is affirmed, *not* an organisation's terms.

    Sorry, the point I was trying to make was when Argos first recalled all these, the argument we were making was that payment had been taken so contract had been made. They argued back stating that according to their t&c's (number 2.3 if i remember rightly) contract was not made until dispatch. They soon changed what they were saying when we started proving that dispatch had occurred.

    So even using their own argument, those who had the product recalled shoudl recieve the reduced price dsi, without having to use any sort of contract law to argue

    Does this make sense?? Sorry I know what I am trying to say just cant seem to get it out lol xx
  • help! i've scrolled and scrolled through pages of dsi traumas and stresses but i can't see what number i need to phone to sort this out?

    I am now giving it a go with Ebays customer services directly about my reserve & collect DSi - they have emailed me back & said the item is not £79.99 & to check the item number. So ive forwarded them a copy of the original invoice which includes a pic & easy to read £79.99 in big print. Worth a try, nothing to lose - all to gain. Lets get them.

  • s'ok i've found the number now at argos, and checked the stock levels locally, all good so far, just need to ring them tomorrow and get them to honour the contract!

    I do not completely understand your point but suffice to say, post 705 explains the contractual obligations the vendor had.
