It had left the possession of Argos. Mine arrived into the local Home Delivery Network depot at 8pm on Wednesday evening - due for delivery on Thursday. Infact mine STILL says it has been dispatched to me for delivery 31st December on their website tracking page. Printed that off then!!

    Mine says exactly the same!
In their t&c's it says it is not ours until DESPATCH,but on the phone I was told it is not til I sign for it,they are changing their own t&c's,can they do that?

No it's despatch. And I've still got my tracking page saying it was despatched on the 30th.

My point is that there is no need to lose sleep fretting over this. By all means try the Argos complaint and small claims court route, but don't be surprised if you don't succeed. Meanwhile all those other bodies will do nothing, so don't waste your time with them.
If you have proof of dispatch, and their T&Cs state that the contract is bound then, then you probably have a very good case. Otherwise don't get too het up about it.
Good luck to those of you who manage to get one.

We aren't getting too het up about it. Just trying to help each other out and think we do have a good case. This was for my son for his birthday next week, and if I hadn't been reassured that that was the correct price from Argos Direct before buying it, then I would have shrugged and said, I missed a bargain - but they told me it was a sale price!

For all the people on here threatening Watchog, Trading Standards, Advertising Standards Authority, Small Claims Courts, The Law, My Dad etc. I would point out that years of MSEing has taught many of us not to lose any sleep over missed bargains.

From my point of view, there is a big difference with 'not losing sleep over missed bargains' and being unfairly and unlawfully treated.

Although I don't agree with every tom, !!!!!! or harry jumping on the 'I should have got one' bandwagon....nor do I agree with allowing companies to ride roughshod over consumer's rights simply because they feel they can.

If everyone always lay down and allowed companies to breach consumer rights, then we would be at the hands of giant omnipotent beasts of our own making.

It's tough on all those who weren't able to pick up a reserved console even although others could but that's a fact of life, some you win some you lose. But it's wrong to accept an order, take payment, dispatch and then cancel. This breaches their own t's & c's, never mind statutory rights.

It's about standing up for your rights in this case, more than it is about losing out on a bargain.

    (Imo) :D

Lol...no of course they can't. That's a classic case of someone on the phone, on the spot, making it up as they go along. :D

Same as when they told me they would be charging people the extra difference in price afterwards. :rotfl:

Same for me,I expressly asked if it was a genuine sale price and "joked"about never receiving it and he assured me I would have it the next day!
What happens to our money that goes immediately from my account not to be refunded for 7-10 days with no goods?!

i payed for my 2 on my argos card in store and received them there and then for £79.99 each does this mean that they will now add the rest of the money to it? or am i ok as the sale was completed and goods received?

Argos are not only in breach of there terms and conditions, which frankly are not worth the paper they are printed on. Consumer law and Contract Law, completely override there t&cs. If payment has been taken, you have already formed a contract. There is not a judge in the land that would not side with you. I think Argos are going to receive a huge backlash from this. This is about principal more than anything else now. I for one find it disgusting that they think they are above the law, and making up the rules as they go along. I was one of the lucky ones, i reserved instore and picked it up same day. For those of you still waiting for your parcel, that believe it has been dispatched. Call your local HDNL depot (they are working tomorrow). Tell them that you believe Argos have mistakenly recalled your parcel. That it is incorrect and you wish to receive your item. You have purchased it, money has been taken and it is legally yours and you wish to come and pick it up straight away. HDN will not know what is going on, there system will just state STOP AND RETURN, thats all. I would try to intercept it, them parcels will still be in your local depot because no waggons will be going in until Sunday night at the earliest. So there is no way Argos have them back yet. Hope some of you manage to get them this way. Make sure that you state your case in the way i have said it. I do know what i am talking about, i used to work for them and i still know staff that do. Good luck all.

No Joey, they wont do this. They cannot.

I just quoted what I was told by a csa as an example of them just saying whatever comes into their head at the time.
