URGENT! car swap problems

hi all my bro in law has advertised his 1.2 ren clio v reg for sale since september, early november one of his friends said he'd swap his 1.4 saxo for his clio as the insurance was cheaper for his m8 on the clio.
they swapped cars week before christmas after BiL's m8 test drove the clio checked it over BiL has explained the cars history to him that the engine was replaced due to big end bearing going, wishbones done, engine mountains done, anti-roll bar bushes, s/link bars done, suspension renewed, new cat, new exhaust, and clutch renewed with a valeo new clutch kit, and the car is listed as cat c (stolen recovered no damage to exterior of car) and handed him the VIC cert.
BILs m8 was happy and swapped they exchanged v5 green document slips.
the saxo was on a private plate so BIL has reverted it to its original reg.
two days ago BILs m8 mum called shouting and screaming at him that they have to swap back as the clio is a death trap and said that they still havent sent the v5 off to the dvla for the saxo and claim that theyre still the registered owners of the car and will report it stolen in 5 days if my BIL dont return it back for the clio my BIL has said that he swap back when V5 are in eachothers names and go through swapping again but they refuse demanding they swap right away. theyve continued to call and threaten him since with threats of harming my BIL.
my BIL has sent off the v5 for the clio to be registered in his m8 name. and has asked what is wrong with the clio to be a death trap but they just keep saying its £500.00 worth of repairs they cant afford and want the saxo back and avoid mentioning what needs to be done to the clio.
What can my bro in law do at this point he has insured the saxo now costing him £35.00 to change vehicle details with insurers. £20.00 for new plates.
he's been to the police for advice but they said it was a civil matter but if they continue to make threatning calls they will have a word with them relating to the threats.
does bro in law have to swap back? what can he do if they report the car stolen? (i dont think police would get involved if they did try and report it stolen)

you need to get more information about what the £500 worth of repairs are...and where they've taken it to get that opinion...they could be trying it on..0

they say they have had a garage look at it but refuse to say where to and what the repairs are.
just shout and scream at him to return the car.
my concern is that they have damaged the car them selfs its snowed hard here before christmas day and froze when it melted its snowing again today.0 -
your BIL doesnt need to do anything,if he wants to keep his new car then that is that,there is no legal comeback,
maybe they have had trouble with the insurance? or his mum/dad are not happy with the car having been stolen/recovered.
but as said, if he wants to keep his car then so be it,and if they phone and make threats keep a record of them and pass it to the police

Caveat Emptor applies to swapsies as well. Your BIL has been far more honest than many would've been. Certainly a lot of sellers would've "forgotten" about the long list of repairs.
At the end of the day, it is a V reg Clio. Its OVER TEN YEARS OLD. Its not a new car.
As others have said, I think they're trying it on. Tell them to take him to court where they'll be forced to substantiate their claim.0 -
i have said to BIL to log all calls time/date/convo. the boy who swapped is 18 yrs old and car was in his name, so he would have to make the court application. my concern is them not sending the V5 for change over would you advice that he applies straight away or just leave it a while.
my BIL keeps all his receipts as i do aswell to prove the car was looked after not battered, he has all the documents for the car and the spare keys to the saxo and alarm fobs.
i cant understand why they would want to have the saxo back the clio is much better in spec and in condition
clio spec:
1200cc/engine (engine replacement had 42000 miles on it) shell done 64000miles
clean body,
14" OZ alloy wheels with new tyres all round not a mark on em
all new suspension parts and mountains, exhaust and cat.
full clio sport 182 leather/suade interior and leather stearing wheel door cards and clio sport floor mats etc.
cat 1 alarm
stereo and hidden 6x9 speakers.
saxo spec:
1.4 furio (vtr lookalike) 120.000 miles engine needs work (has oil leaking from rocker cover, oil breather hose has been broken from air box to accomodate induction cone)
drivers seat needs two floor pan bolts to secure properly,
air bag light is on (driverside and passenger airbag sensors are disconected for some unknown reason)
exhaust is blowing from manifold
no stereo cant fit one as harness is missing need rewireing.
just cant find any justifaction as to how they would want the saxo back other than he has damaged it in snow.

as I said it may be the fact that as the car has had substatial damage and reqquired a VIC check that this may have affected the insurance premium,
get your bil to apply for a new reg doc from DVLA this can be downloaded and printed from here

clio didnt sustain any damage when it was stolen and recovered apart from a driver window and barrel caseing this is why BIL bought the car back.0 -

BIL has said he will swap, but wanted a saxo and dont mind doing the repairs.
if this other guy got no comeback on this then i guess he'll have to go to court0
