This evidences that the Karlsruhe radar fault was not material enough to affect any other airline. I would be grateful if you can suggest any reasons for the fact that all airlines other than yourselves were not affected by Karlsruhe. It strongly suggests to me that you have taken an operational decision to rebalance your plane positioning and clearly your decision not to fly when not supported by any other airline does not constitute proof of 'extraordinary circumstances' required by article 5.3 of Ec216/20040 -

I have studied the extract from the operating log that you have provided.
However, it seems to bear no link with the public record of arrivals and departures from Munich on the evening in question. Flights due in between 21.00 (25 minutes before the incoming Stansted flight was due) and 22.00 were generally arriving on time – or with a slight delay. Similarly flight departures from 21.00 to 23.00 were departing on time.
The only cancellations for the evening of Sunday 30th May 2010 were all easyJet flights.
This is evidence that the Karlsruhe radar fault was not material enough to affect any other airline.

In view of easyJet's Chief Executive being on record as stating that “there is not enough flexibility in our scheduling and crewing when things go wrong” it remains my view that easyJet took the opportunity to rebalance its aircraft positions for the next day with flight cancellations and aggressively attempt to minimise the cost of reimbursing its affected customers.

I have jut found this site having had an Easyjet flight cancelled on Monday 6 September scheduled at 21.50 from Geneva to Liverpool. The incoming flight was the 18.35 from Manchester.
I have looked up flightstats from link above (sorry not allowed to quote it) and according to that my cancelled flight arrived at 02.00! The incoming flight from Machester, which did not come in as far as I am aware, is also showing as having flown.
We were told it had it had taken off and had to return to Manchester because of a Medical emergency.
I know Geneva operate a curfew at 12.00 so if the delay becomes 2hrs 10 mins this flight is going to be cancelled.
My question is obviously before you go to court how reliable is the information on the flightstats site.
As an aside I had to pay to rebook on the 21.50 flight on 9th Sept and on arrival at check in the gate was published. No information was given on screen on the Monday. My ex runs a hire shop in the Alps and has had a lot of customers disrupted by cancelled Easyjet flights.

Hi Thanks to richardw for quick response. Have just spent the past 30 mins reading this thread from the start. Have not contacted Eayjet re claim yet because waiting to see if I get hit with additional car parking charges at Liverpool. As it was at 11.00pm I put in my ticket expecting it to be rejected and the gate opened:). (It was pre paid and 3 days overdue)
Have now a better idea of how to go about it. One gripe is the morning after the cancellation my Easyjet account made no mention of a "disrupted flight" or the possibility of booking an alternative flight without further charge. When phonong their customer services I was told they would refund reasonable expenses but of course I do not have tht in writing. Annoying now that they charged me £150 for the flight home instead of just issuing anew booking reference without charge. Logging onto my EZ account now and the option is there butno way quick enough.

Interesting --- EJ monitor this thread - they have identified that our dispute over the Munich flight is being discussed here and referred to it as follows
I note that you have also been communicating with members of the blog community. I should make you aware that, having reviewed their posts on several occasions, they have a habit of finding malicious intent on the part of easyJet where none is actually present.
For EL consumption - no one has suggested malicious intent in our case - just commercial decision making -- that it will be cheaper to cancel the Munich flights and have tomorrows airplanes and crews in the right places and ready to fly.
Current position
From an initial outright denial of any compensation due , thru "a we will refund your court costs of £30" , they are now offering flight vouchers valid for a year to a value well below the monetary claim. This could be because they now know that any legal fees we incur are covered by insurance - so ongoing costs of this case could cost them but not us.
Important -- does anyone know how I can obtain information from Karlsruhe radar - to either support or disprove EJ claim that Karlsruhe radar was operating at 50% and therefore EJ had no option but to cancel. EJ cancellations seem unneccessary as I am unable to find any other cancelled flights in N Europe at the time in question.

EJ state that karlsruhe radar had only 50% capacity and that they therefore had to cancel all their UK flights due into Munich that evening - and that this was "extraordinary".
However no other airline cancelled any flights into or out of Munich or Dusseldorf - and a "reverse" mirror image flight Nurenburg Stansted had no trouble either. We are trying to obtain confirmation of the Karlsruhe position from them - the delayed passenger speaks fluent German so may be able to make some progress there.0
