Sofa Delivery delay - Can i do anything?

I ordered 2 new sofas from a well know furnitre company on October 4th. That weekend all the furniture shops were pushing for the 'order this weekend for guarenteed Christmas delivery' deal. So we placed our order.
As the order was logged onto their computer system we were told that is was flagging up as delivery into our local warehouse on December 7th, with delivery to us sometime that week.
I rung up on the 7th to check progress and was told that it hadn't arrived yet, but as further deliveries were still to be made it could arrive into the night and was told to ring the following day. I rung on the 8th to be told that it hadn't arrived and that a new date of the 17th was displying on the computer system.
I rang on the 18th to be told again that it hadn't arrived and that they would chase it up with the supplier and come back to me. I'd not heard anything so have rung this afternoon, and they said that the delay is due to the weather. I asked if it would be here before Christmas and they said that they didn't know.

I pointed out that the weather was not to blame as it was originally due in on the 7th and the weather wasn't an issue then.

Do i have any legal rights to claim compensation if the sofas don't arrive before Christmas?

Is anyone else having similar problems?

    I have 3 mates who over the years have ordered for g'teed xmas delivery and they've all been let down.

    No, your contract will have something in it about "reasonable delivery time" and it'll be something like 3 months - time to read the small print.

    Ordered two leather recliners from company (Martin Kemp has a lot to answer for), back end of October and told 6-8 weeks.

    Started chasing after 8 weeks and was told due in on the 17th December, took the day off and waited.

    I called them the next day, to be told only half of the order had arrived and they are waiting for the other parts to arrive before delivery.

    Been calling every day, similar story but always something slightly different.

    Called into the shop today as was passing, was told a different story about suite being loaded onto two different containers and one has been rerouted to another port due to waether. But they are expecting 6 containers in today and more in tomorrow.

    Come home to find that they have called my wife, and now said suite won't be in till after the 2nd January and they will call then with updates (not to organise delivery, UPDATES).

    Give them an ear bashing on the phone, and was looking on here for some advice.

    Our paperwork does state that they consider a delay of upto 4 weeks reasonable, but I'm going to see a Solicitor on Wednesday to see how that effects the pre Xmas delivery statements.

    I'm looking at, either them breaching the contract as unable to supply pre Xmas, or that a 50% increase in contracted delivery times is not classed as a reasonable increase in the contracted delivery time.

  • We ordered two sofas early Sept 09 (not from DFS) with a 12 - 16 week delivery slot. On 30th Oct advised by email from local store that they would be delivered first week December. End November rang to find out exact delivery date to be told they were still somewhere in China! They did agree to let us borrow one display sofa and then also delivered another (different) sofa the week before Christmas. The 16 weeks were up on 2nd Jan, but due to the snow we did not chase. We then had a call last week (15th Jan) to say our sofas were now in the country and would be delivered 31st Jan! - and that we did not owe any money. We queried this (?!) and were then told that we owed in full (less original deposit) even though the local store said they would arrange some discount. The 'Customer Service' department have not replied to our emails - have they broken rules in not adhering to their own terms & conditions and what can we do???? We still have the two random sofas!!!!
  • you were lucky to get something to sit on, we ordered a corner unit in november, they have been paid, and like you we were promised delivery, initially 8 to 12 weeks, then in time for christmas, then new year due to poor weather, then by 8th january, then last friday, now waiting with baited breath and sore btm. from sitting on the floor, for delivery tomorrow, but they didnt call as promised to confirm delivery time.trying to keep positive, but......:mad::(

    I'm having similar problems and am getting quite worried now.

    I ordered 2 sofas from a company called trade suites (not sure if i'm allowed to post links but do a search on google - they are in bridlington) in september 09. Originally told 8-10 weeks delivery, then got pushed back to delivery week after xmas, weather issues pushed it back to two weeks ago and now just keep getting told 'next week'! I haven't been able to get hold of the company for the past two days and i'm a little worried about whether or not our sofa's actually exist
  • We ordered our DFS sofa in October, still waiting for ours, luckily not needed urgently as we still have our existing one. Being told that they are going to be with us by 20th Feb now.

    Unluckily, friends across the road ordered their sofa's on the 'delivered in time for Christmas' deal with another retailer and arranged for the council to collect theirs on 20th Dec (they said they had been promised delivery on 22nd, but haven't seen their paperwork to confirm) and still no sofas. We've loaned them bean bags and they've borrowed a futon but they've no confirmed delivery yet either.

    Has anyone else had a delivery estimate of Feb?

    I'm afraid you should be worried. You may already know but it seems they have done a runner. We also have lost a lot of money to this criminal.

    As a point of interest....have you heard of Dropshipping? Well this is exactly what the shops like DFS do, you purchase/deposit the sofa etc they then purchase it from their Dropshipper, usually China.
