    Hi Fayei,

    You seem to have got quite a lot of your charges back, can I just ask you, did they all back down before court and if not then do you have to attend court if they decide to defend ??

    I would love to try to reclaim charges but it all seems a bit daunting. :eek:

    Hi Ju,

    Some of it has been easy, some not so, but i only started reclaiming last july / aug time and it was the best thing i could ever have done for myself.

    Most took just one or two letters, and others i had to take to the FOS. The FOS were in favor of myself on a store card account, but after the courts decision with the banks, they said the banks had treated me fairly on two account, as they had given me £1136 back out of £1880. so it can go both ways.

    I got all of my letters and help from this site, you will need a few ours to sit down and type them all up, depending on how many accounts you have.....took me ages:rotfl:

    Go for it and let us know how you get on....

    I have had a reply from littlewoods saying they're looking into my complaint, but im sure i will have to take this one to the FOS!

    Mickwitt - you can claim back the full charges, whether it is £12 or £24 or whatever they used to charge. Although it is recognised that £12 was a fairer charge, only a court can decide what is actually fair, so therefore they shouldn't charge £12 when it only costs a few pence to send the letter.
    The charge isn't just for sending the letter. It's for all the collections activity that the company has to carry out when you miss a payment.

  • hi, wondered if anyone can help, i sent my letters off and got the usual reply, saying its stated in terms and conditions etc and they would not refund any of my charges, it also said i could write to FOS within 6 months if i wasnt happy with the reply, an now the six months has passed,but now ive realised that some people have had successful claims, can i still try and reclaim, if so what should i do next ??

    any help would be really appreciate

    If your concerned you have passed the six month mark, just send off another letter to littlewoods or whoever, you'll probably get the same reply which will give you another 6 months to contact FOS. I dont see any reason why you cant do this???

    Dare you to prove it? Only a court can decide what is a fair charge. I can source the information about only a court being able to decide what a fair charge is under UTCCR 1999, can you source the costs for collection without going through the process involved which WILL involve a cost to the provider(before you suggest that I am saying there is no cost)?

    Hi, hope it is OK to cut in to this thread - I'm a newbie so forgive me if I get the protocol wrong!!
    I'm after advice, as among our many debts which we have just totalled up (!!) are 2 catalogue accounts which were with Shoe Tailor (Oxendales) and Jacamo (Sander & Kay Ltd) but are now both with DCAs CapQuest and Reliable Collections. I have wrtten to both DCAs asking for write-offs but they have agreed to £1 per month for 6 months then review - well it was worth a try :(
    We paid loads of 'late payment charges' on these accounts and will be claiming them back however I need to know whether I write to the catalogues or the DCAs for account statements/info and how do I change the CC Relaiming SAR letter for a catalogue?
    I have been checking out the guides and forums and am in the process of totalling bank charges for a reclaim from Abbey National on Financial Hardship grpounds but I am stuck on these ones.
    Hope someone can help or direct me accordingly ............. pretty please

    You need to write to the companies concerned asking for your data from them.

    Many thanks for that - I thought it would be them but just wanted to check - I have prepared my letters and all I need now is the 2 x £10 to send with them - can't afford that just yet after all my £1.14's for my Recorded Delivery letters to my creditors!!! You can see how tight things are :( Never mind, a couple more have already replied accepting token £1 per month so that is a start.
