  • I sent the standard letter to MBNA, but they have ignored it. I'm going to send it again recorded delivery (which I should have done in the first place of course).

  • Dear all, I have copied below the letter I am about to send MBNA in repsonse to their letter. Not had a chance to send this before now as I'd been away for New Year. Can someone advise me in whether or not I am saying the correct things before I send this away today?

    I am writing to you in response to your letter dated 15th December 2009 regarding my MBNA Credit Card Account, as I do not accept the decision made by yourselves not to refund my PPC and the expected 8% statutory interest.

    The letter you sent is extremely disappointing, and I am indeed furious with the outcome of your decision. I was expecting a far more positive reply from a company of your stature.

    Firstly, I would like to remind you that your VERY pushy sales person did NOT give me the correct information when the policy was sold to me. The sales person also implied that this policy would assist my credit application and credit rating for the foreseeable future.

    The attitude of your sales person was totally unacceptable, and I felt I had no other option than to say ‘yes’ to this. I also found that I was NOT given clear information on what the policy would and would not cover. This is a clear indication of mis-selling products and is therefore not tolerable.

    Secondly, I am requesting a copy of this phonecall which gives my verbal authorisation to add this policy to my account. I would like this in either written transcript or in disk format.

    As clearly stated in my previous letter, I HAD previously tried contacting yourselves to cancel this policy, and once again your sales person informed me that I couldn’t cancel. This contradicts what you said in your letter about having 30days to cancel, although I never did give my authorisation too add it in the first place.

    Unless you can satisfactorily justify to me that the policy was fair and reasonable I am requesting a full refund of all premiums, and subsequent interest on these payments, that I have paid to date. As I believe I have been deprived of this money, I also expect 8% statutory interest, the amount a court would award, to be added to each payment made.

    If I receive another negative letter from yourselves at MBNA, I shall be requesting an SAR from you and will then in turn approach the Financial Ombudsman Service, who I am sure will clearly see in my favour.

    I look forward to a full and prompt response to this letter and for the matter to be concluded within eight weeks or I shall be contacting the Financial Ombudsman to investigate my complaint.

    Its a great letter, well done.:T:T

    However, if this is the 2nd letter, depending on how long you waited for the first decision, I would not give them a further 8 weeks.
    Say if you received the first decision by 6 weeks of your first letter, then I would give them say 14 days, to make up for the 8 weeks if you know what I mean.
    If you do want to give them longer its up to you, or give them say for example 14-21 days as from the date on your letter and post by recorded delivery, for your proof of posting, and you can check the delivery status on this on the Royal mail website.

    I always send important letters by recorded delivery,so I can cover my back.Just wanted to post the letter onto this thread to make sure I am saying the correct things.

    Yes thats fine.

    Because as you know on the first letter you send its 8 weeks they have, then say for example you received your response by 5 weeks, then give them 3 weeks and so on, but that is fine anyway to write 14 days as discussed.;)

    I still haven't heard anything back from MBNA after sending my letter off to them on the 5th Jan. No surprise there to be honest.

    I've noticed on here that quite a few people have called them to dispute their decision and have been successful. Should I follow suit also?

    The reason I am asking this is because I've made a slight mistake in my letter and have only just noticed it when sorting my files. I've noticed that I have put the wrong date on the letter and is way off the mark from 5th Jan. As stupid it was not to notice this, but I was that angry with them, I just wanted the letter sent. Could this be why they are delaying the decision? I did say that I wanted a reply within 14-21days of letter dated.

    Yes I would certainly give it a go doing this, as this may possibly be the problem here, go for it and post by recorded delivery as well to make sure it arrives with them.;)

    I always send letters by recorded delivery and the post office website confirms that my 2nd letter was delivered on 7th Jan 2010. It's just the date at the top of my letter that is concerning me, as they might be using that to delay their decision.

    So, that's why I am asking if it is such a problem and maybe it's better for myself to call them.
